(Note: Meeting was conducted in accordance with the Attorney General's guidelines and observed the Governor's executive orders and the Secretary of Health's public health orders.) 1. Opening Items A. Call to Order by the Honorable Mayor Daniel R. Barrone. The Honorable Mayor Daniel R. Barrone called the Special Meeting of the Taos Town Council to order at 4:00 p.m. B. Roll Call Ms. Francella Garcia, Town Clerk, called roll and a quorum was present. Those present were: Mayor, Daniel R. Barrone Mayor Pro Tem, Nathaniel Evans Councilmember, Darien D. Fernandez (arrived at 4:03 p.m. due to technical difficulties) Councilmember, George "Fritz" Hahn Councilmember, Pascualito Maestas Also present were: Town Manager, Richard Bellis Town Clerk, Francella Garcia Town Attorney, Stephen C. Ross C. Pledge of Allegiance Councilmember Maestas led the Pledge of Allegiance. D. Moment of Silence Moment of Silence was observed, and a brief period of reflection was made by Mayor Barrone. Taos Plaza Visitor Information Kiosk Update. Councilmember Evans made a motion to approve the agenda as amended. Councilmember Hahn seconded the motion. The motion passed. March 23, 2021 Minutes of Town Council Regular Meeting Councilmember Evans made a motion to approve. Councilmember Hahn seconded the motion. The motion passed. The Councilmembers voted as follows: Ayes: Evans, Hahn, Fernandez, Maestas. B. April 26, 2021 Minutes of Town Council Workshop Meeting Councilmember Evans made a motion to approve. Councilmember Hahn seconded the motion. The motion passed. The Councilmembers voted as follows: Ayes: Evans, Hahn, Fernandez, Maestas. 3. Awards and Recognitions There were no items presented under Awards and Recognitions. 4. Presentations (Agenda Item 8.C was presented before this item.) A. Taos Plaza Visitor Information Kiosk update by Director of Marketing and Tourism Karina Armijo. (Agenda item followed Agenda item B.C. per amended agenda.) Director of Marketing and Tourism Karina Armijo updated the governing body of the partnership with the Taos County Chamber of Commerce (TCCoC) on the opening of the Taos Plaza Visitor Information Kiosk on May 14, 2021. She informed the Council a memorandum of agreement (MOA) was established for TCCoC to manage volunteers to operate the kiosk from Monday through Friday. The opening received a favorable response from the public, and she believes the kiosk will be helpful to the businesses in the plaza and to the visitors. Ms. Armijo thanked TCCoC for assisting the Town and acknowledged the Facilities Department for refurbishing the space. 5. Citizens Forum A. Citizens who wish to comment before or during the meeting may submit comments or questions to Town Clerk Francella Garcia at fgarcia@taosgov.com. No action may be taken. Consent Agenda - The items in the Consent Agenda below have been reviewed by the Mayor and the Mayor has placed these items on the Consent Agenda for the purpose of voting on all items with one vote. The items listed are for the Council's consideration and approval. A. Discussion, consideration, and possible approval of Resolution 21-22 authorizinga time extension for participation in the Municipal Arterial Program p--- - --p p 9._. (MAP) administered by the New Mexico Department of Transportation (NMDOT) and authorization for Mayor Barrone to sign the amended grant agreement. The Town of Taos share of this project at 25% is $37,956, the NMDOT share at 75% is $113,869, the total agreement amount is $151,825. (Public Works Director Francisco Espinoza) Councilmember Evans made a motion to approve. Councilmember Hahn seconded the motion. The motion passed. The Councilmembers voted as follows: Ayes: Evans, Hahn, Fernandez, Maestas. 7. Matters from Staff A. Discussion, consideration, and possible approval of the Children, Youth & Families Department Grant Agreement 21-690-3200-20848-1 in the amount of $68,390 for fiscal year 2021-2022. (Grants and Revenue Development Director Lynda Perry) Grants and Revenue Development Director Lynda Perry stated the grant agreement is effective July 1, 2021, and is the second year of a four year contract. She explained the programs are designed to keep at-risk youth out of the court system. Ms. Perry stated the Town is one of three municipalities in New Mexico that manages these programs. Councilmember Maestas requested a copy of the comprehensive strategic plan from the Juvenile Justice Board. Councilmember Hahn stated his only concern about the program is the state has a four- year commitment; however, it does not include the cost of living adjustment. He further added these programs need to be funded appropriately. Councilmember Hahn recommended when the contract is renewed for a four-year term, to encourage the state to include the adjustment. Page 3 of 15 Councilmember Hahn made a motion to approve the CYFD Grant Agreement 21- 690-3200-20848-1 in the amount of $68,390 for fiscal year 2021- 2022. Councilmember Evans seconded the motion. The motion passed. The Councilmembers voted as follows: Ayes: Evan, Hahn, Fernandez, Maestas. B. Discussion, consideration and possible approval to destroy Town records eligible for destruction pursuant to Resolution 20-47, held in accordance with the New Mexico Administrative Code 1.21.2 and 1.21.3, unless otherwise specified in i:he Town of Taos Records Management and Retention Policy. (Town Clerk Francella Garcia) Town Clerk Francella Garcia stated that this agenda item includes a list of records eligible for destruction from the Finance Department, the Human Resources Department, and the Clerk's Office. According to Town of Taos Resolution 20-47, all Town records shall be retained following the New Mexico Administrative Code 1.21.2 and 1.21.3, unless otherwise specified in the Town's policy attached to the resolution. Councilmember Maestas asked whether the records were kept electronically. Ms. Garcia stated purchase orders and the payment of invoices are scanned; however, scanned records are also retained according to the New Mexico Administrative Code. Councilmember Evans made a motion to approve Resolution 20-47. Councilmember Hahn seconded the motion. The motion passed. The Councilmembers voted as follows: Ayes: Evans, Hahn, Fernandez, Maestas. (Note: The Council ratified the destruction of records at the Town Council Regular Meeting on June 22, 2021.) C. Discussion, consideration and possible approval of Resolution 21-24, "A Resolution of sponsorship for an application to the Transportation Project Fund and Project Match Commitment for Camino del Medio in Taos, Taos County, New Mexico." (Public Works Director Francisco Espinoza) (Note: Agenda item 8.0 was moved before Agenda Item 4. A.) Grants and Revenue Development Director Lynda Perry stated the proposed resolution needs to be included with the grant application, which is due by 5:00 p.m. today. Public Works Director Francisco Espinoza presented Resolution 21-24. Mr. Espinoza stated the resolution authorizes staff to submit an application to the New Mexico Department of Transportation for transportation project funding, a new initiative released by the Governor for infrastructure projects. Mr. Espinoza stated he believes the Town has a good chance of being awarded the grant. Staff is requesting $3.6 million, and there is a Town match of $180,000. The funding will be used to reconstruct 1.75 miles of Camino del Medio, and_it is anticipated the project will be shovel-ready when grant awards are announced. Page 4 of 15 Councilmember Evans made a motion to approve Resolution 21-24. Councilmember Hahn seconded the motion. The motion passed. The Councilmembers voted as follows: Ayes: Evans, Hahn, Fernandez, Maestas. D. Discussion, consideration and possible approve of Resolution 21-25 "A resolution of the Town of Taos supporting the affordable housing program application by Chelsea Investments Corporation to the Federal Home Loan Bank of Dallas for AHP funds to renovate and preserve the Mariposa Apartments, and declaring the proposed project supports the Town's community revitalization efforts." (Town Manager Richard Bellis) (Mr. Bellis' microphone was not working.) Mayor Barrone stated this affordable housing program is needed in the community, and the Town looks forward to participating in any way possible. Robin Pelton and Brent Murray, representing Chelsea Investments Corporation, thanked the governing body for their support and stated they look forward to a successful project and contributing to Taos. Councilmember Evans made a motion to approve. Councilmember Hahn seconded the motion. The motion passed. The Councilmembers voted as follows: Ayes: Evans, Hahn, Fernandez, Maestas. E. Discussion, consideration and possible approval of Resolution 21-23 a resolution of the Town of Taos declaring a civil and health emergency and authorizing public health and safety measures. (Town Manager Richard Bellis) Mayor Barrone stated proposed Resolution 21-23 observes the Governor's executive order and the Secretary of State's public health order. Discussion ensued on face mask requirements and the current guidelines and restrictions established by the most recent public health order. Mr. Bellis requested the Council to continue to enact the health emergency resolution until it is cleared from the federal and state level. Councilmember Evans made a motion to approve Resolution 21-23 with the newest New Mexico Public Health Order as the superseding document. Councilmember Hahn seconded the motion. Councilmember Evans requested further discussion. Councilmember Evans stated for clarification if a business wants to continue the face mask requirement, the Town will support and enforce this directive if the Police Department is called. Councilmember Hahn friendly seconded the motion. The motion passed. The Councilmembers voted as follows: Ayes: Evans, Hahn, Fernandez, Maestas. F. Direction to staff with regard to potential changes to the Liquor Control Act for the issuance of restaurant licenses for the sale of beer, wine, and spirituous liquors, allowing restaurants to sell spirituous liquors produced or bottled by craft Page 5 of 15 distiller licensees, and home delivery of alcohol, unless the Town chooses to opt- out through an ordinance. (Town Manager Richard Bellis) Ms. Garcia updated the Council of changes made to the Liquor Control Act, effective July 1, 2021, unless the Town adopts an 'opt-out" ordinance stating that such licenses are not allowed. She informed the governing body that new restaurant licenses will allow the serving of beer, wine, and spirits. There are now three types of restaurant licenses: • Restaurant License A - Service of beer and wine only; • Restaurant License B - Will allow for the service of beer, wine, and spirits; and • Restaurant License C - Licensee may be issued New Mexico spirit-use liquors permit, which allows the licensee to sell beer, wine, and spirit-use liquors produced or bottled by a craft distiller licensee. In addition, the Liquor Control Act permits residential delivery of alcohol by certain licensees and third-party delivery services. Furthermore, there will be a change in the hours of sales of alcoholic beverages, particularly on Sunday sales. Ms. Garcia provided an overview of the service hours for package sales and restaurant alcohol service and changes to the craft distiller's licenses. Ms. Garcia informed the governing body Senate Bill 2 passed on March 5, 2021, waives all renewal fees for 2021 by the Alcoholic Beverage Control Division. She requested the Council's direction on whether the Town should also waive the 2021 liquor license tax of $250 to licensees. Mr. Bellis stated if the Council is familiar with Senate Bill 2 to give direction to the Attorney, Town Clerk, and himself to draft a resolution for the next Town Council Regular Meeting. Otherwise, leave it as is, and it becomes effective July 1, 2021, or he and the Town Clerk can send a copy of the changes with remarks on the impact of each of the changes for public comments. Councilmember Maestas asked whether the Town can opt out of specific changes made to the liquor control act. Town Attorney Stephen Ross stated he would do a legal review on the options available to local governments, and he will report back to the Council. Councilmember Evans recommended the Town and the County should be consistent with each other to avoid confusion. He further added he would like to observe what other entities will do. Mr. Bellis recommended at the next meeting of the Enchanted Circle Council of Governments to discuss what other entities are doing. Mayor Barrone stated he would like to review the information by Mr. Ross and learn what other entities will act upon. Mr. Bellis recommended collecting the 2021 liquor license tax, which the Town could use towards responsible drinking campaigns. There were no objections by the governing body. Page 6 of 15 G. Discussion, consideration and possible action with regards to implementing and/or enforcing the term of a standardized rate agreement for the provision of sewer service by the Town to governmental customers. (Town Attorney Stephen Ross and Town Manager Richard Bellis) Note: Continued from the April 27, 2021, Town Council Regular Meeting. Mr. Bellis stated the rates are calculated according to law and approved by the state and the governing body. The rates have to reflect the actual cost of providing the service. There are partnering entities who want the Town to underwrite the cost of service because they don't want to pass the expense to their customers. He further added the Town pays for services that other people do not and gives discounts to people that no one else does, and the question is whether that is legal. Mr. Ross stated the answer to Mr. Bellis's question is no. He further added public utilities have to charge just and reasonable rates. There are no underwriting or discount rates to particular customers because it is unfair to others who pay their share of cost-of-service. Additionally, the Public Utility Act also reflects general common law on public utility rates, and the statute is very clear that public utilities must charge fair, just, and reasonable rates. Mr. Ross discussed the expenses involved with providing public utilities. Mr. Ross stated he observed the two agreements with El Valle de Los Ranchos, and the Taos Pueblo was not consistent with the Public Utility Act or the common law; therefore, he changed the agreements. However, since then, there has been nothing but disappointing context, particularly with El Valle de Los Ranchos on these issues. Another problem with these agreements is determining the amount of sewage put into the system. Mr. Ross discussed establishing a public utility rate setting and the difficulty determining the amount of sewage put into the system coming from other entities since the outflow and inflow are not metered. Mr. Ross stated the Town, as a public utility provider, has the burden of establishing that rates are fair and just and cannot be done by making assumptions. He emphasized the Town needs to know. Otherwise, chances are other customers will subsidize the cost of service. Mr. Ross explained he rewrote the agreements to provide for rates based on a rate study, and there is reluctance to agree with that. The main problem is the disagreement with the essential function of a public utility. Furthermore, the Public Utility Act is an established law that goes back 150 years, and he does not believe the Town has much leeway when it comes to these matters. Mr. Bellis stated there is a general desire in the community to eliminate septic systems and hook-up to sewer. The Town is more than happy to do that if people are willing to pay for this service; however, this has not been the case. The Town has not been paid for extraterritorial hook-ups, or in the case of the Taos Pueblo, they want to determine what to pay the Town. Furthermore, when the license for the treatment plant is up for renewal, the Town needs to comply with the federal government's structure standards, or Page 7 of 15 the license will not be renewed. It is estimated thirty to thirty-five million dollars in new capital projects that the Town would have to pay, while other entities disagree on rate increases. The Town offered to install meters which would be billed into the rate and were agreed upon in the original agreement; however, other entities want the Town to pay for the meters. Mr. Bellis emphasized the Town is planning ahead to see how it can take on additional obligations. Mr. Bellis proposed Mr. Ross send a letter that states effective immediately, there will be no new hook-ups for contract customers with the Town of Taos until the new rate ,7reement is signed, or they have ;until July 1 st to find nn alternate source. Mr. Bellis reminded Council that these discussions with other entities have been ongoing for thirty years in some cases. Councilmember Maestas stated he believes a new rate study is needed. He further added that everything needs to be metered for the desired outcome, and everyone is paying their fair share of sewage treatment. The cost-of-living adjustment is inviting an unnecessary disagreement over a very small portion of the rate. He believes a new rate study, metering, and obtaining a fair bulk rate would contribute to the desired outcome and implement a cost-of-living adjustment moving forward. Mr. Maestas stated these entities are the Town's partners and our community members, and the Town needs to work with them. Discussion ensued on charging bulk rate, the cost to El Valle de Los Ranchos, an increase of effluent from Taos Pueblo, calculating the cost-of-living-adjustment into the rate, whether attaining a new rate study is necessary, adjusting rates to the new rate study, the cost benefit to entities to use the old rate study, and how often rate studies should be conducted. Mayor Barrone stated for the record Councilmember Maestas is willing to use the new rate study to mandate entities to pay the share they are required to pay. Councilmember Maestas stated if connections are metered, the rate can be determined and billed. Mr. Bellis stated the Town does not control the connections. Other entities are tapping into the Town's system and are not creating their own lines. Councilmember Maestas stated the Town needs to know what is coming through the mainline. He recommended no new connections, and the connections that are already in place are to be metered. Mr. Bellis stated the Taos Pueblo is metered, and an agreement has been in place for over thirty years; however, the Town is still not getting paid for this service. Mr. Bellis stated unless the Council tells him that institutions are special customers who need to be treated differently, he believes it is his obligation to send a letter to entities stating they can't keep ignoring the contract with the Town, and they cannot tie into the lines unless the Town approves it. Finance Director Marietta Fambro stated entities connect directly to the Town's trunk line for free and collect hook-up fees from their customers. Page 8 of 15 Mr. Bellis emphasized the Town does not know what other entities are putting into the system, such as erecting a mobile home park that is not metered. Councilmember Maestas stated he agrees to no new connections and a Cost-of-Living- Adjustment (COLA) increase. Moving forward, these entities should be treated as commercial customers and metered to determine how much sewage is put into the mainline. Mr. Ross stated nobody should be connecting into the Town's sewer line without authorization, it is illegal, and it should be made clear to them that they cannot do that. Mayor Barrone stated entities are requesting that they be given a year to verify whether the meters are working correctly. He further added the Town is not collecting enough revenue for upgrades and cannot continue to defer action. Furthermore, as stated by Mr. Ross, rates are to be calculated according to law. Councilmember Hahn stated he will support Mr. Bellis, and he believes a letter needs to be sent out. Furthermore, the Town needs to limit its exposure, and the entities need to be noticed and given two years to comply. Councilmember Fernandez stated he does not believe it is unreasonable to send the notice and move forward with a new rate study. Mayor Barrone directed Mr. Bellis to send out a letter and attain a rate study. Mr. Bellis stated the majority of the million dollars owed to the Town are from governmental institutions. Furthermore, he does not believe it is fair to treat governmental institutions differently than a taxpayer. Mr. Bellis stated he will draft a letter for legal review and forward it to the Council before it is sent out. Discussion ensued on whether SMA would be able to prepare the rate study. Mayor Barrone stated he would like the rate study to be done as soon as possible and do whatever needs to be done to obtain. A motion was not made by the Council. H. Discussion and direction to staff with regards to the proposed Interim 2021-2022 Fiscal Year Budget. (Town Manager Richard Bellis and Finance Director Marietta Fambro) Finance Director Marietta Fambro presented the Fiscal Year 2021-2022 Interim Budget Review. Ms. Fambro provided an overview of how the projected general fund revenue of$11,831,834 was estimated in the interim budget. She informed the Council the general operating costs increased by $733,970 based on budget requests from the departments. Ms. Fambro stated the personnel service is approximately seventy percent of the Town's general fund budget. She presented options affecting personnel services for Council to select (attached to the minutes) and addressed questions from the Council. Page 9 of 15 Councilmember Evans stated the fire excise tax needs to be addressed. The Town is taking a "financial hit" for providing services outside the Town of Taos limits, and he believes the services should be covered by the fire excise tax already being charged to the Town and County residents. Furthermore, there should be a positive regionalization conversation with other entities. Councilmember Evans stated he believes the Town should plan for a zero budget and recommended staff keep the temporary increase of one dollar, plus an additional one dollar raise. Councilmember Evans stated he believes the Town needs to have a succession plan. Human Resources Director Tamara Chavez and Mr. Bellis briefed the governing body on hiring staff for the Fire Departments to offset overtime costs, create a safer operational environment for firefighters when responding to emergencies, job rotation, and regionalization of the Taos Fire Department. Mr. Bellis and Ms. Fambro discussed the shortage of staff and the additional workload resumed by the departments. Mr. Bellis emphasized the Town needs to raise revenues for Town operations. There has been an increase in PERA, medical insurance, and unfunded mandates from the State of New Mexico and the Town has no control over that. Mr. Bellis recommended the Council approve the temporary budget and defer the one dollar pay raise to employees until January, so the Town may have the opportunity to increase revenue. He further recommended the use of the one-time funds to outsource Town projects. Mayor Barrone stated the Town needs to generate continuous revenue to maintain the Town's infrastructure, hire staff and increase employee wages. Councilmember Maestas stated he reviewed prior Town budgets, and there has been a significant increase to the Town's reserves, specifically the One-Time Costs Fund (53). He requested an explanation of the 1.1 million dollars, which was transferred into the One-Time Costs Fund and Reserves from the General Fund in the 2018/2019 Fiscal Year. Ms. Fambro explained the Town is required to budget for job positions; however, there are unused funds due to the turnover in staff and job vacancies. Additionally, departments indicate they will expend their budget; however, they do not have the staff, and the money is not spent. Therefore, the funds are reverted to the One-Time Costs Fund. Ms. Fambro further added it is not unusual for a municipality to allocate money that is not spent. Before implementing the One-Time Costs Fund, the Town transferred unused funds to vehicle maintenance or capital. The Town implemented the One-Time Costs Fund to help with the budget, and the majority of these funds are used for capital projects and one-time expenses. Councilmember Maestas stated due to the repeated transfers of additional funding to the Town's reserves and the One-Time Costs Fund, he believes the Town has reoccurring money that the Town can use towards funding the staff, rebuilding the workforce, and compensating employees well. He further added Option 4 includes additional staffing Page 10 of 15 positions and the pay increase to employees totaling approximately 1.1 million dollars. Councilmember Maestas stated he is advocating for filling job positions and paying Town employees better. Mr. Bellis stated it was difficult to find people who want to work in government before the pandemic. Health care benefits and retirement were a great incentive; however, government jobs are less attractive since retirement is now expensive, and individuals have access to universal health care. Extensive discussion ensued on vacant job positions, the additional revenue needed to fund the job positions on Option 4, addressing pay rate compression and how it negatively affects pay equality, employee morale and the retention of employees. Human Resources Director Tamara Chavez informed the Council since becoming the director, the number of employees went from 170 to 118 employees. Councilmember Hahn recommended the Council select Option 3 with full succession planning. He proposed reclassifying one-time monies as reoccurring revenues and completing the succession management positions. Furthermore, succession managers could be delineated, and a portion of their salary can be paid from the enterprise fund that they are directly involved with. The deficit would be six hundred eighty-four thousand dollars. Councilmember Hahn recommended reducing the Judicial Department, Recreation, the Taos Public Library, the pool, the Taos Visitor Center, and the Council's salaries by thirty-five percent to balance the deficit and fully staff the Town's departments. He further added the Town needs to move forward aggressively and with a promise to the departments affected, that the Town's goal is to restore these budgets within a year to eighteen months. Mr. Bellis discussed the decline in the number of tourists stopping at visitors centers due to mobile technology to access information. Ms. Fambro explained the budget for the Visitor Center is allocated towards salaries for the Marketing and Tourism Director, a portion of the Facilities and Special Events Director, and one full-time employee or temporary employees. It is not for the operations of the Visitor Center. She further added that today's discussion is for the Council to give staff direction on the Council's priorities for the 2021-2022 Fiscal Year Budget. Ms. Fambro stated the Town's interim budget is due to the Department of Finance and Administration (DFA) by June 1, 2021. Councilmember Maestas stated he believes if the Town was in a poor financial position, the Council should consider the option proposed by Councilmember Hahn; however, the Town is doing very well. The Town has $2.8 million in reserves, $3.0 million in One- Time Costs Fund (Fund 53), and it appears the Town is over-budgeted $2.0 million due to funding that the Town will receive from the American Rescue Plan Act (ARPA) within the next two years. Councilmember Maestas stated due to the total amount of the Town's reserves, he would not support a budget cut to the Taos Public Library or the Youth and Family Center. Page 11 of 15 Discussion ensued on whether One-Time Fund Costs (Fund 53) can be reclassified as reoccurring operating revenue, whether the Town can use enterprise funds, staffing departments, and the increase to operating costs. Mayor Barrone stated the Town provides services to the entire region. The Town needs to be innovative to generate revenue to continue these services. Furthermore, the Town needs to maintain its reserves for emergencies such as repairs to its wells. He emphasized it only takes one incident to deplete the Town's reserves. Mr. Bellis stated reserves are also needed for reimbursabie grants since it may take several months for the Town to be paid back. Mr. Bellis requested consensus from the Council. He further added there are policy decisions to be made, and whether Council wants to do them, and decide how to pay for them. Mr. Bellis stated direction from the Council is needed so that he and Ms. Fambro may finish the budget. Councilmember Evans stated, for the health of the community, he disagrees with budget cuts to the Taos Public Library and the Youth and Family Center. He recommended Taos County supplement the cost of services from the Taos Public Library and the Youth and Family Center or charge County residents thirty-five percent more for these services. Councilmember Evans recommended a property tax increase since most of the increase will go towards commercial property and out-of-state residents. In addition, there should be a fire tax, and the Town should charge the County for the fire services provided by the Town. Councilmember Evans recommended deferring the extra one dollar raise to employees until January and determining how to implement a succession plan. Additionally, there is not a significant savings in reducing the Council's salary. He further added he disagrees with discontinuing the 1/8 gross receipts tax reserves. Furthermore, the Town should maintain the reserves where they are; however, the Town should do its best to use the excess money. Councilmember Fernandez stated he agrees with a property tax increase since it will target out-of-state corporations and second and third homeowners. He further added he would not support the thirty-five percent blanket budget cuts on service programs such as the Youth and Family Center and the Taos Public Library. These departments provide a quality of life to the community, prevent substance abuse to the youth and attract visitors to the community. Furthermore, there are opportunities for the Town to generate gross receipts tax from recreational activities at the Youth and Family Center. Councilmember Fernandez emphasized the budget is not just a financial or policy issue, it is also a moral issue, and the Town needs to look at it under those auspices as well. He proposed having fewer police officer positions at this time and having a conversation with Taos County about contributing additional monies or a commitment to creating a recreational district that would help fund recreational activities and share the cost. There are funding resource opportunities available for much-needed infrastructure improvements without reducing vital activities for the youth. Councilmember Fernandez stated if elected public service is unattainable unless you are rich, then all the laws in the Page 12 of 15 county will be for and by the rich. He reiterated he could not support the thirty-five percent reduction. Mayor Barrone asked Councilmember Fernandez whether he was agreeable to the additional one dollar raise to the employees in January after determining the Town has the revenue to fund it. Councilmember Fernandez stated he would consider that approach. He further stated the Council should consider operating with a 3/12 reserve instead of the 4/12 reserve. Furthermore, it is important that the Town have reserves; however, during the audit report by the Town's accountant, having a lot of resources available and not addressing the community's needs is a concern. He further added there is an opportunity for the Town to encourage economic development, support vital services for the youth, give employees a raise, and maintain some reserves. 9. Matters and Reports from the Town Manager A. Coronavirus update by Town Manager Richard Bellis. Mr. Bellis did not provide an update. B. Matters and Reports from the Town Manager. Matters and Reports from the Council A. An update on the Regional Coalition of LANL Communities. (Councilmember Fernandez) Councilmember Fernandez stated Santa Fe County and Taos County voted to withdraw from the coalition. Additionally, the Town received numerous requests from constituents to retract as well. For a few years, the coalition has been attempting to re-establish itself as a more relevant and responsive entity; however, with the recent withdrawal of memberships and the uncertainty about future funding, the coalition decided to begin dissolving the organization. Councilmember Fernandez requested that the Council not present a resolution to withdraw from the coalition, so the Town can partake in the dissolution. Mayor Barrone agreed and requested Councilmember Fernandez keep the governing body informed. Councilmember Evans thanked Councilmember Fernandez for his service as the coalition representative for the Town. Page 13 of 15 B. Matters and Reports from the Council. Councilmember Maestas stated he has seen a rise in graffiti and has also received a call from a constituent about the increase of graffiti. Additionally, the Town's graffiti hotline telephone number no longer works. Mayor Barrone stated he also spoke with the constituent and informed him to call dispatch if he witnessed it in progress or call Executive Assistant Cathy Romero to report the incident. He further added the property owner is responsible for graffiti removal due to the anti-donation clause. Councilmember Maestas asked when the Youth and Family Center will reopen. Several organizations are looking for summer initiatives for the youth. With the end of the school approaching, he believes there should be activities for the youth. Mayor Barrone stated a portion of the Youth and Family Center is open. Mr. Bellis provided an update on the hiring of personnel for the Youth and Family Center. He further stated the threshold to reopen is July 1, 2021; however, reopening programs is dependent on hiring staff. Furthermore, he prefers that the Youth and Family Center reopen in the summer so that new employees can receive training. Mr. Maestas stated he would like to discuss a letter of support with Taos County regarding the film industry, and he would like this item to be placed on the Joint Work Session Meeting with Taos County next week. Mayor Barrone agreed. He further added that the cost of everything continues to increase, however, there are no additional revenues. The Town and the County need to determine how they can work with each other and grow together. Mayor Barrone emphasized a town that does not grow dies. Councilmember Maestas stated several County Commissioners approached him about contracting with a third-party facilitator between the Town and the County. He further added he believes it is a good way to move forward to address complex issues. Councilmember Hahn provided updates on the Taos County Cooperative Weed Management Area, the irrigation of Kit Carson Park, the Vigil y Romo Acequia water- sharing negotiation, the pending decision on selecting the Holy Cross Hospital Board positions, and the operations of the Taos Recycling Center. 12.
