V11) Citizen Concerns
A. Citizens wishing to speak shall limit their comments to 3 minutes. No action may be taken.
Chris Armijo, AFSCME Representative spoke about the proposed 3/16 gross receipts tax (GRT) to
contend giving the full 3/16 to the hospital. They are asking that 1/16 of the GRT to go to the Emergency
Medical Services Department (EMS) in order to help the department with recruitment and retention of
EMS Technicians etc. They believe that the community should have a voice on how this money is spent.
Diana Lester, Paramedic for Taos County EMS and Vice President of AFSCME Local 1193 asked the
commission to delay this vote to consider giving 1/16 of the GRT to the EMS Fund. She talked about the
county only having two ambulances available on most days for the entire county and 1/16 GRT could
help transform the department.
Pamela Aiken, Chief Nursing Officer at Holy Cross Hospital (HCH) stated that the national average for
nursing turnover is 17.1% and the hospitals turnover was at 21% now they are at 6% a great
improvement. They had 6 traveling nurses last year and 3 of those positions have been filled in the last
year in the OR. They are also working with students to fill these vacancies. The hospital is making huge
improvements she asked that the 3/16 goes to the hospital because the 1 mill is not enough to sustain the
hospital. EMS has had months to ask for help.
Teresa Trujillo, 37-year HCH employee stated that she supports the GRT for the hospital and is very
proud of the hospital's accomplishments. The transparency is also appreciated she asked the commission
to support the hospital. They also submitted a petition signed by over 200 people to the commission.
Lenora Cisneros a 31-year employee of HCH asked the commission to support the hospital and to keep
health care local.
Susan Cady, Taos County Chamber of Commerce said the business community depends on a well-run
hospital she asked the commission to support the GRT for the hospital.
Colleen Durocher said she is running a federal grant in Taos, Questa, Clayton and Raton to improve
maternal outcomes. She has been an employee of Holy Cross Hospital for six months she is part of the
leadership administrative team. She spoke about the work environment at HCH the CEO values the
opinion of his team, he runs an effective tight ship, and there are high levels of transparency. She asked

the commission to trust and support the hospital and its board. The hospital is an economic engine for the
community she asked the commission to approve the GRT.
Maryanne a Taos County Paramedic stated that the hospital needs support but so does EMS they need
GRT to support the department they need enough employees and equipment. EMS should not be self-
supporting. The community needs to support EMS right now they all need it.
Linda Freedman a 40-year employee of HCH said she agreed with Marjorie Luckey's article in the Taos
News regarding hospital funding. Prior to the county issuing GRT the commission needs to be certain that
it will be spent on most essential needs. She talked about the management action plan for Taos's
identified health needs. Rio Grande Alcohol Treatment Center presented a plan and requested financial
support from the hospital and the hospital has not answered his request. Women are avoiding HCH for
delivery especially if babies are born addicted, they are referred elsewhere why was the 3-million-dollar
federal grant for OB services not used to train staff for those types of issues. Community engagement and
support is vital for a successful hospital.
Dr. Tim Moore from HCH said he agreed with what Linda stated but the hospital does not have financial
resources to expand the nursery, train, or teach care for those infants. The needs of the community are
always changing the need now is coronavirus they are meeting tomorrow night to address response to the
threat. He is also here representing the medical staff because they are working right now taking care of
the health needs of the community. He will appreciate any and all support of the hospital.
Dora Hall, a nurse recently moved to Taos in 2018 she is also a cardiac patient. It is important to her to
have the hospital here she came here for that reason and for this community and she was overwhelmed
with welcome in Taos. She asked the commission to support the hospital.

IX) Presentations
A. A Presentation regarding Taos County's Financial Audit for the period ending June 30, 2019 -
Cordova CPA's LLC - Robert Cordova, Principal -Cover Page/Taos County Commission

Bobby Cordova, representing Cordova CPA's presented Taos County's Audit Report for Fiscal Year
2019. The financial statements are public documents and available for public viewing on the county
website or the State of NM website. Auditors opinions and reports were presented. Mr. Cordova stated
that they were onsite July of 2019 for this audit working closely with the Finance and Treasurer's Offices.

The exit conference was held November 25, approval of the audit was given on December 30t'', and the
`�.. financial statements were released on January 8th by the State of NM. That document shows the financial
health of Taos County. The auditors gave Taos County an unmodified opinion it is a clean opinion. There
were no major findings in the audit. The prior year finding was resolved. Mr. Cordova also discussed
protecting the county's assets this is the highest risk the commission should invest in training.
The commission thanked Mr. Cordova for the report and the firm for their hard work during the audit
period. Commissioner Fambro mentioned that NMC will soon be offering coverage for cybersecurity.
B. A Presentation by LMNOC Broadcasting for the use of Filemon Sanchez Park for 2020

JoJo Valdez, LMNOC Broadcasting requested the use of Filemon Sanchez Park for 2020 Mother's Day
Concert it will bring economic growth to the community. Their radio market has expanded to Raton and
Trinidad area and that will invite more people to the area for the event. This will be the 19`h year for the
event that took place at the Filemon Sanchez Park for 14 years and a few at the town.
Liza Mascarenas, Business Manager of LMNOC stated that they filled all the requests in the
memorandum that the county required. Chairman Blankenhorn thanked them for the info this decision
will be made by administration.
Commissioner Fambro said there was damage done to Field #2 from last year's event and complaints of
trash left in the area. He asked Scott Frost the Facilities Director to speak about the last event. Mr. Frost
stated that there was damage to the field it is scarred grass was lost there was also trash left in dugouts
and near the home because it was not cleaned up well. Commissioner Fambro asked why the event did
not happen at the town park. Liza Mascarenas said the Town of Taos is not hosting concerts until June
1 St.
JoJo Valdez stated that last year the storms washed out the event with the exception of Sunday that is the
reason for the damage to the field he hopes that is not an issue this year. There will be a deposit given to
the county this year of$1,500. Dino Silva spoke about the damages done to the field by the trucks and the
beer tent. Commissioner Fambro asked management to take note of his points.
Vice-Chair O'Donnell asked Scott Frost if the deposit will cover any damages and if the broadcasting
company is hiring ambulance personnel if they will be working overtime etc. Mr. Frost said everything is
much better prepared this year. Anissa Arrambide stated that they are providing their own security and
they will be in contact with Taos Police Department if they do not cover it then the Sheriff's Department
will be contacted any overtime will be discussed with them. The county's bathrooms will not be used the
county is much better prepared and everything is in the contract. Commissioner O'Donnell asked about
recycling and food vendors also to stay away from using plastic. Mrs. Mascarenas said there are about 10-
15 vendors. Anissa Arrambide said there will be recycling bins provided by Solid Waste.
Commissioner Gallegos stated that he supports this idea but he asked if the fees are incorporated for
lighting and trash pickup. He added that a walk through should be done at the end of the event.
Commissioner Romero said this has been a good event for years he asked them to talk about what this
event does for economic development. Mr. Valdez stated that this brings value to the county as owning
the event they will bring awareness of recycling, what events are in Taos County, they can promote the
county in any way they can and this brings money to businesses of the county. Commissioner Romero

said he supports the event and thanked them for the presentation. Vice-Chair O'Donnell asked them to
send documents to the county to promote the event.
X) Catwassink,of Election
A. Canvassing of the Municipal Officer Election for the:
1. Village of Questa
Renee Martinez, Village of Questa Municipal Clerk presented canvassing results of the March 3, 2020
Municipal Officer Election. It was an unopposed election: absentee voters 0, early voters by tabulator 52
election day voters 48 for a total of 100 votes. For Council Brent Jaramillo 78 and John Anthony Ortega
88 votes also Municipal Judge Michael Rael 88 votes.
Commissioner Jim Fambro made a motion to approve the canvassing of the Village of Questa
Municipal Officer Election as presented. Seconded by Commissioner Gabriel Romero. A roll call
vote was taken indicating the following:

�..,. Ann Marie Wooldridge, Taos Ski Valley Clerk and Barb Wiard, Presiding Election Judge presented the
Municipal Officer Election canvassing results from March 3, 2020. Election Day Voters 41 Early Voters
47 and Absentee 19 with 107 total ballots cast. Renato Frimm 3, Neil King 60, Roger Pattison 39, Tom
Whitman 60, Benjamin Cook 45. The two candidates with greatest number of votes filled the positions
open.
Commissioner Gabriel Romero made a motion to approve the Canvassing of Taos Ski Valley
Municipal Officer Election as presented. Seconded by Commissioner Candyce O'Donnell. A roll
call vote was taken indicating the following:

Francella Garcia, Town Clerk presented the Municipal Officer Election canvassing results from March 3,
2020 for two councilmember positions. Results were as follows: Nathaniel Evans 556, Darien D.
Fernandez 469, Rodger D Martinez 124, Billy Romero 416. There were 6 provisional ballots received on
election day and only 4 were qualified by County Clerk,Anna Martinez.

Kimberly Armstrong, Owner of the Trading Post Cafe said she had to reapply for a liquor license because
her husband passed away and this was the only way to get his name off of the license.
Commissioner Tom Blankenhorn opened the public hearing at 10:16 AM.

Chairman Tom Blankenhorn informed the public of the hearing rules and opened the Gross Receipt Tax
(GRT) Ordinance Public Hearing at 10:17 AM.

Chris Stagg: I am the current Chairman of the Board of Holy Cross Hospital. I've served on the board for
8 years and I come here today to ask for your support of this resolution. I'm not going to take up a lot of
�-' time. I've made many presentations I think we've provided information to the council and we'd be happy

to provide more today if there are questions. Again, I thank you and I urge your positive consideration for
this resolution. Thank you.

Bobby Duran: I am a lifelong resident of Taos County, I served my community for 28 years in the
legislature, as a city councilman, and as a Mayor of the Town of Taos. I also served on the board of the
hospital in the early 2000's. I am here to ask you to consider the gross receipts and one of the reasons is
everyone has to pay it. We the taxpayers that have properties if you see the list on our taxes it is about that
long on all the different taxes but if we use gross receipts the native americans will pay it and they don't
pay taxes on their properties. People that live in housing don't pay taxes on their properties and tourists
they come in and they don't pay taxes on property. So, it would be to our advantage to have everybody
pay on the gross receipts I am here to encourage you to consider the gross receipts. Thank you very much.

Gale Martinez: As many of you know I do work at Holy Cross Hospital I've worked there for the past
10 years. As a part of that I have also been a part of this community serving actually alongside you in the
various capacities in the government entity, in the business sector, as well as now at the hospital. That
actually offers me a unique perspective. One of the things as I was looking at the issues before you was to
say, what are some of the common grounds? and how do we help lead into the future for our community?
With that, I submit to you that it is around the public health, safety, and welfare of our community of
which you each have been asked to serve as well as all the HCH staff. That is the common ground that is
the leadership piece. We are asking you to favorably look to support the 3/16 gross receipt tax on behalf
of our community. Both of our organizations as the hospital and as the county commissioners of Taos
County are being asked to lead. Could it be for this moment for this time that we can help create the
opportunity to sustain a healthy future for our community? Thank you.
Marjorie Luckey was sworn in by Transcriber, Tammy Sandoval.
Marjorie Luckey: I am a Physician and a resident of Taos County and because I am not on the staff of
Holy Cross Hospital, I have no conflicts of interest to declare. I really appreciate this opportunity to speak
for a few minutes and ask for your consideration. Let me first state the obvious, every person in this room
particularly those who have had the courage to ask questions cares very deeply about the success and the
survival of this hospital. I also want to be very clear that I agree with you that we must continue to
support with taxpayer funding the hospital and I support your decision to place continuation of the mill
levy on the November ballot. However, I strongly object to the commission passing additional taxes
without first demanding more transparency from the hospital about how this money is going to be spent.
Just as you would not consider giving money to a county agency without seeing a detailed business plan
the same should be requested and required from the hospital before you give away taxpayer money.
Without this information it is not possible for you or the public to be confident that providing this money
will contribute to the long-term survival of the hospital rather than simply providing a temporary band-
aid. I understand that you don't feel comfortable or want to micromanage the hospital but we the pubic
depend on you to be diligent managers of taxpayer money. Letting the hospital off the hook of the
minimum standards of a business plan and market analysis you not only risk throwing money away but
you could inadvertently be risking the survival of the hospital itself. Without you having the information
you need you may have not noticed that Holy Cross is facing one of the most serious threats to the
survival of rural hospitals in the United States. This is a phenomenon called bypassing it is a condition in
which local residents travel outside of the county for their healthcare taking their healthcare dollars with
them. Between 2015 and 2017 Holy Cross Hospital lost more than 9% of the Taos County market share
`-- of inpatient admissions to other regional hospitals. At the same time, in 2018 Holy Cross's patient

satisfaction scores were significantly lower than those of our neighboring hospital in Espanola it could be
that taxpayer dollars are most needed for hospital services and community outreach that would keep
patients here in Taos rather than going elsewhere. So what I am asking is that the county add a
requirement to dispersing any taxpayer money to the hospital for a detailed business plan and an
independent market analysis and assessment of how well the hospital is meeting the community needs.

Chris Armijo: Just to basically summarize what I addressed at the public concerns, we know this is
weighing heavily on the community, and weighing heavily on yourselves. Once again, my name is Chris
Armijo I am the AFSCME Council 18 Staff Representative, representing the county employees both blue
and white collar and Sheriff's Office. I have to basically concur with the speaker before me that before
you make any decisions because there's been, I am trying to find the correct word,but for the last 8 years
that I am aware of there has been some financial concerns as to what's been going on at the hospital. I
think before the County makes any decisions on how they are going to, oh before they make a decision to
approve this resolution, they really should get some answers from the hospital. How they are going to
spend this money basically an assessment, a business plan, that would be wise. I think, anybody that
invests in a business you want to see that. So, I think that will be well taken as advisement for you all to
review that because you are dealing with public monies. Once again, I am going to back off that and go
back to during the course of negotiations last year we pretty much did our own market analysis of EMS.
We did find out that they were below market. We are grateful for the raises they received last year and
actually for this coming year and next year we did a 3-year plan but it is still going to keep them under
market. I think it is very important that the commissioners realize that because they are under market. Set
aside 1/16ths of that 3/16ths so we can provide for our EMS for recruitment and retention. I know that I
am not exactly sure how the hospital is going to spend the money. How much is operations? How much is
on wages? I know that there's a fair amount of traveling nurses that aren't a part of this community they
are for the time that they are here and we appreciate them coming out here and we pray that they love it so
much that they remain. But with all that being said and done, we really need to take care of our own.
Once again, we respectfully request that you take all that we had to say into consideration first of all on a
business plan, an assessment, so you make sure that all of the monies that you plan on distributing or
releasing to the hospital is well spent. That it has a plan, we can hold them accountable, and once again if
you remember our own county employees that strive everyday to better this community and to serve them
wholly. Thank you.
Commissioner Blankenhorn: Well thank you Chris. Let me just say that, well first off, this debate has
been going on for quite some time and when Commissioner Fambro came up with this kind of formula
for about half of it continuing an existing mill and the other half in this 3/16 it was with a particular
number in mind. It's a number much lower than the hospital was hoping for but its one that is reasonably
constructed to ensure that the hospital has an opportunity to replace some of their equipment, to upgrade
our building, to increase their cash reserves and we are hoping to give the hospital an opportunity. I have
no doubt that there are some issues that we need to address with EMS but in my opinion, this is not the
forum for it. We know what the capital needs are of the hospital we know their cash reserves are well
below a healthy level that would allow them to operate with the kind of efficiency that we would hope
for. That will tend to mitigate some of the movement to other hospitals and so that's just one
commissioner's opinion on your request.
Chris Armijo: Thank you Mr. Blankenhorn. Thank you for sharing that with me we were brought into
the fray if you will about a week and a half ago still kind of sorting things out but we believe that 1/16 the
EMS is asking for will go far and wide to help them with once again recruitment, retention and building

morale. I believe that the county should be grateful for the services of EMS and just asking that you take
that into consideration.
Vice-Chair O'Donnell: I would like to state my personal opinion too. If you could still stay up here Mr.
Armijo. I do appreciate your clever way of presenting. I appreciate you as a union leader I did want to I
will let you know in case you didn't that I have attempted several times to lower this ok, and my motion
has not been seconded. Just so you are aware I have made attempts to lower this amount by 1/16th and it
was not even heard. Although I appreciate your efforts there is not the support by this commission. I
would like our Attorney to explain if we were which we probably aren't going to change the amount if
our attorney could explain the process that would have to be done.
Attorney Randy Autio: Commissioners, Vice-Chair O'Donnell and Mr. Chair the question becomes
whenever you are going to amend something is whether or not there has to be a republication of the
agenda item because if it is a significant enough change so if you were going to look at another amount
today it would have to be republished because there should be notice of the exact amount of tax change so
we would probably have to republish on it.
Commissioner Romero: So, Mr. Chairman in terms of a higher GRT do we have that capacity at this
point?
Commissioner Fambro: We still have 4/16.
Chairman Tom Blankenhorn: Or a quarter.
Commissioner Romero: So, if we did consider that in an effort to address the issues of EMS is that
something that we could do.
Commissioner Fambro: Yes. We have that in our ability.
Commissioner Romero: I would like for us to address that idea even if it prolongs the process but I do
feel that we need to address the issues that EMS and the union have brought forward.
Commissioner Fambro: I just think that it's important to clear something up. Part of the fire excise tax
which is a '/4 cent tax I believe there's a certain percentage my memory is its 25% of that goes to EMS
then in addition the last 3 years the average general fund transfer to EMS has been $165,000 so the fact
that they are not getting, I mean. I just think that it is important that the public knows that part of the fire
excise tax does go and it is also when we did the bonding we lumped all of the debt service into that as
well from EMS and like I said we are averaging$165,000? I am thinking.
Lupe Martinez,Finance Director: $400,000 from the general fund.
Commissioner Fambro: $400,000 from general fund and the fire excise tax is $165,000 so just to clear
that up.

Robert Silver: Good morning commissioners, with regards to Holy Cross Hospital this is not my first
`-- rodeo. As some of you may know I took an intense interest in the functioning and governance and

management of the hospital going back some 7 years. Over a period of 3 years I was a regular fixture at
Holy Cross Hospital board meetings, as a matter of fact I think it is safe to say that I probably qualified as
a skunk at the garden party. I expressed my opinions over a period of about 2 '/2 years in the newspaper at
length most of which began with intense criticism of the management and governance of the hospital. Let
me just quickly take you down, a bit of a walk down memory lane. When I first became curious and
interested in the hospital, I refer to this as the bad ole days in those days they had a CEO who managed
mostly by fear, intimidation, and bullying of the professional and ancillary staff. They were terrified of
the retribution that he would put out if they spoke out about the problems that were endemic within their
functioning organization. On further inquiry, we found that three of the board members had served an
aggregate total of 69 years they were effectively board members for life. They were not exercising any
vigorous oversight over the functioning of their CEO who is essentially to my way of thinking leading
them around by the nose. The hospital board operated pretty much in secrecy and this was anything but a
transparent organization. Things changed remarkably and I became a convert rather than a critic. I was
delighted to see Bill Patten's arrival even though I don't agree with everything he does and certainly not
everything he says before I agree with all of that he has cause to worry and so would I and so would you.
Fortunately, that is not the case. Nevertheless, I assume that his judgement and his Chief Financial
Officer's judgement about the financial needs of the hospital are true and accurate I have no reason to
believe him to be anything but an honest reliable person whose heart is in the right place and who
operates with integrity. Nevertheless, I would go beyond the request that Dr. Luckey has made in terms of
what you should require with regard to funding at least opening the door to public funding of the hospital.
The people need a seat at the table and a voice at the table they also need a vote at the table. I am well
aware that the hospital's bylaws and the lease agreement that you have with the hospital precludes
commissioners from serving on the board. Nevertheless, I think the fact that the door is being opened to
millions of dollars in public revenue should demand a quid pro quo it should go along with a quid pro
quo. Changing those documents so that there are three seats that we are entitled to having members of the
commission as board members of the hospital and that's what I would ask you to do require this quid pro
quo before opening the door to further public funding of the hospital. Thank you.

Susan Cady: I am a citizen in District V. Just to counter what was just said by the previous two people
we are now facing a pandemic that we don't know what's going to be required here in our community.
Having the hospital have control of some funds that are discretionary for immediate use to respond to
what's current as they are going to do with the meeting tomorrow night is important. So I would say
whatever oversight that you've already talked about I'm sure is sufficient and the hospital needs the
ability to care for the community with whatever's happening at the time. Thank you.

Dr. Tim Moore: This will probably be the briefest amount of time I ever spent at this podium. I am not a
member of the administration of this hospital. I serve on the board to represent the medical staff and there
are many times when I am maybe at odds with the board about that but I am always allowed
representation and I am always heard. I am volunteering my services in the following way: I am available
and will be available to any member of the public or the press at any time, at any place, to describe and
explain every single item that may be on a list of a hospital's needs. I will be happy to explain it to the
public so that they understand what the medical need is for that desired item. I don't think there can be
any more transparency than that but I feel strongly enough about this hospital and about the wellbeing of
this community and the welfare of a medical staff that feels a little demoralized by having a public debate
about whether or not there is public support for the community that they serve. So again, I am always
available to explain to any member of this community any item on any list that comes before or that is
�- paid for by public funds. Thank you.

Chairman Blankenhorn: Thank you doctor and we appreciate the detail that Holy Cross has showed us
over the past year the capital needs and frankly the disclosure. I am personally grateful for that.
Vice-Chair O'Donnell: I do have a follow-up for Dr. Moore and possibly Mr. Patten. So, since someone
brought up the corona virus you may come back to the podium. Do you have any idea of your
contingency fund your emergency fund that you set aside that ultimately will come out of these GRT's,
what will that amount be? And if you haven't figured out the numbers yet what do you have in your
contingency fund?For emergency situations such as what we may be facing?
Dr. Tim Moore: Well we don't have a large sum of money that is there for emergencies.
Vice-Chair O'Donnell: How much is it?
Dr. Tim Moore: Again, I am not a financial person so I have no idea. The response is the first step which
is to say what do we as a medical staff and a hospital need to do to protect this community against the
potential risks that could unfold. Out of that will be a plan a contingency plan for doing that and then I
suspect that as that plan is formed then we can look at what financial resources are needed in order to
support that plan its always done in relationship to what resources we have but first we have to have a
plan before we will know what financial cost it will be.
Vice-Chair O'Donnell: Dr. Moore you probably already should have had a contingency plan for
emergency situations and done a cost estimate so I appreciate your answer so I think for planning in
general for emergency you should already have one. You probably do maybe Mr. Patten knows about it
but perhaps some of this mill levy we are going to see an increase in emergency planning and the need for
additional resources. Thank you.
Dr. Tim Moore: There are always contingency plans for all types of emergencies that that may unfold
and I don't want to give the impression that the hospital is ever ill prepared for anything that we
encounter. As a small rural hospital we have to be even more ensued to such plans because we serve a
broad base with a lot of different needs.

Dr. Joanne Ishmael: I have been a member of the medical staff since 2001, I've been Chief of Staff, I've
served as leader of many of our committees and I've been on the Board of Directors for 7 years at various
points in time. To your point Commissioner O'Donnell, we do have an emergency plan in place that is
not funded by contingency funds that is part of our budget. However, the novel COVIDI9 is something
that nobody ever anticipated until December of 2010 and certainly we would be more prominent in the
world had we been able to foresee that emergency here in Taos County. With regards to our planning for
COVID 19 we have outlined a preliminary plan we are meeting with the medical staff as a whole to get
the entire community coordinated response before we roll out the plans to the public so that that public
plan is coordinated communication is clear and exactly what will be needed is not yet clear. We are doing
an assessment of what resources we currently have before we know how many resources we need to
purchase with regards to persona protective equipment coordinating with the NM Department of Health
how we are going to go about rolling out evaluation and testing of patients. So yes we do have an
emergency plan in place however specific to the COVID 19 is really going to be taking place and
finalizing we had part of that meeting this morning with our pediatric and adult medicine meeting but we
are going to bring in all of our community stakeholders which includes multiple outpatient clinics, EMS
and the Department of Health. So, I hope that answers your question.

Vice-Chair O'Donnell: It does and Mr. Chairman I apologize for going into the weeds here but we'd
hope that the Town of Taos might step up and lend them in the event that old detox building that has 10
beds that could be used as some kind of isolation unit.
Commissioner Fambro: Point of order, Mr. Chair this is a public hearing regarding Ordinance 2020-01.
Chairman Blankenhorn: Right but the hospitals importance to the community is part of this discussion
regarding the potential effects of this virus. Let's move on with the rest of the pubic hearing.

Lindsey Pfaff Bain: Good morning, I also work at the Taos County Chamber of Commerce the other
Director but more than anything I just want to say thank you to the hospital. Thank you to the people who
work in the trenches every day, thank you to them. As a mother, I have two kids and my second was born
here, great care, and also I have had some close calls with my son. They have come and stepped up in
amazing ways and I am sure every single one of you had instances with your own families that you need
to support the hospital. People move here and they look at schools, they look at healthcare and this is an
economic indicator that you have to support. Not just for you but for your children, for your
grandchildren, for their children, and as a region this is so important for the ski areas. I think this is a great
solution so kudos to you for finding that solution so its not all of the burden on the taxpayer of the land
owners this is all of us coming together and I urge you to please, please, support this. Not just for
economic you know great impact but also for the morale of those people that are in the trenches every
single day at the ER. For the mothers that give up their time away from their children to be at work to
save your children, my children, and also for your parents. I know that we all have been there and I just
urge you please to support this a great solution. We've all been there and I think they are doing a fantastic
job and if you don't then you need to ask questions and go see them and visit the, go see the facility, go
and meet with them there and see what they are going through day to day and maybe that's when your
mind will change. So please support it. So, kudos to you. Thank you. 10:50 AM
Del Endres: First of all, I am totally disgusted with Dr. Moore thinking that the doctors can't be here
because they work. Well people working their second and third jobs in this town and can't be here.
Teachers can't be here, daycare people can't be here, checkers at the grocery stores can't be here, people
who clean the hotel rooms can't be here. So, its not just doctors and doctors get paid a hell of a lot more
than those workers. The hospital won't give us the benchmarks on what our physicians make but the little
bit I get from the 990 is that our physicians are getting paid more than the national average of New
Mexico. That's what I can see I can't say for sure. We've been told a lot of things but the gross receipt tax
is extremely regressive, it's the worst tax to do. It means the people with the littlest have to give more
percentage of their income to this for the tax. That's not what we I don't think what we want to do. I also
think if you vote for the gross receipt tax, can be shooting yourself in the foot, because the mill levy may
be refused then because people are saying why the hell do we have to give more taxes when we just did
gross receipt tax. The gross receipt tax is not a steady stream it varies according to sales its nothing to be
depended on and its been shown according to the Town Council that it starts here and it starts to go down
because people buy less because gross receipt tax is higher. Taos Ski Valley has the highest gross receipt
tax in the state I guess we can just go higher and just be up there higher than that. When we asked about
the mill levy how much money the mill levy gave to the hospital. You know it's one mill levy its so
much less than the 1.25 that other small hospitals got but yet out of the 12 hospitals we finally got the
number Holy Cross's mill levy gave more than the 7 hospitals that were 25 beds and less for hospitals in
that group gave more. But that mill levy is not because the cost of living is so high. They did do a
community health needs assessment but it was done by the hospital and Quorum which is not really an
outside organization. It doesn't talk about the oversight the transparency, the employee satisfaction, the
patient satisfaction, the need and the wants of the community, financial needs and decisions. One of the

things that came out of it was the women in Taos County aren't getting their mammograms as much as in
the state and in the county and one of the solutions was that they did or maybe did before I don't know is
hire a plastic surgeon who did breast reconstruction. If there's something that could make Taos County
women want mammograms more is to have reconstruction surgery thrown in their face. One of the things
on page 5, they talk about a board controlled by independent civic leaders. Our nonprofit board consists
of an employee, at least two contractors and that's against all nonprofit board guidelines that I know of.
Its just you sit there and say, this is not, Chief of Staff at other hospitals aren't not on the board they come
and report to the board but they are not on the board because their decisions are about their income and its
just totally inappropriate. Thank you.
Chairman Blankenhorn: Thank you. Are there any others that wish to participate in the public hearing?

Christopher Medina: I am the Director of the Ambulance Service been there for a couple years now
been with Taos County for over 22 years plus with this department. First, I just want to thank everybody
whose came up and spoke on behalf of my department. It means a lot that people are looking at my
department and you know trying to help us out which you know we do need the help. Everything that has
been said about the hospital as far as needing money for capital for recruitment retention and all that we
face all the same challenges we are the other side of the health care that nobody looks at, we truly are.
Having said that, we are also one of the opinions that nobody's asked about. How does the EMS
community feel about the hospital? We see them day in day out every day we are in every department of
that hospital every day, we transport people there everyday and we transport people out of there all the
time. So we see it, we see it all but nobody comes to ask to see what the pre hospital community says
what emergency services says so I just kinds went off my opinion. Truly we do support the hospital, we
do think they need the funds to help move them forward to help support it and keep people employed
there and try to keep the community safe and you know well. That's what its about this is my community
this is your community. So, we do support we do we also ask and I respectfully ask please don't forget
about the other side of the health care community EMS, don't forget about us because like I said
everything the hospital faces we face. You know this new threat of the coronavirus guess who is going to
be out there picking all of these people up? Guess who is going to be in closed close proximity to these
people all the time? You know so we are facing all these same challenges we just do it at a high rate of
speed and out in the sticks out in the weeds you know ask the community members. Read the newspapers
over the last few months all those articles in the newspaper are about gentleman gored by a bison, cars
rolling over here being extricated, bus crash at Pilar we are there for that we take care of that kind of stuff.
That's all I ask and thank you for the support for everybody whose came up here and spoken on our
behalf. Please don't forget us ok we face all those same challenges. Thank you.

Sheriff Jerry Hogrefe: Good morning, I'm Sheriff Jerry Hogrefe for anybody that can't recognize me in
this room. First, I want to say go Marjorie I was very impressed with what you had to say. Everyone here
has had great things to say today and let me just preface by saying yes, we have to have Holy Cross
Hospital it is our community hospital. There are good stories, there's bad stories, I have my personal
experience of watching my father-in-law lay in that hospital bed for two days before he was transferred
out with a broken hip to receive care from Presbyterian. That was disheartening but I don't want to focus
on that I've seen many good things come from there. Law enforcement interacts with Holy Cross Hospital
regularly as we do with EMS. You guys have a very difficult decision in front of you. You already know
that, you don't need me to tell you that, you are watching the massive drop in oil prices in the DOW and
our country going into potentially a pandemic but mostly hysteria at this time over the coronavirus and
more to come from what that's going to actually believe. We are watching our shelves on our grocery

stores deplenish of toilet paper, bottled water hand sanitizer, anything that says antibacterial on it is
L disappearing like wildfire. That's part of the hysteria of the unknown and what we are watching around
the country you know continents and countries are closing their entire borders. Italy has quarantined its
entire country now. What's this going to bring? We don't know yet but I will say this much that I support
our EMS. My brothers and sisters they are our first line against any of these kind of things and they are
the ones that are going to come save my butt if it get in trouble or if one of my deputies get in trouble.
Lives are saved in the field just as much as they are at our Holy Cross Hospital. I continually will support
them until just very recently there wasn't a concept about a gross receipt for EMS and yes there's been
several meetings going on about Holy Cross. It's a shame that nobody snapped to that sooner but if there
is any way that the commission could reconsider what's on the board from the 3/16 to a 2/16 for the Holy
Cross and give the other 1/16 to our EMS. I think that would be an outstanding event for this commission.
If not, the Holy Cross needs to help they truly do they need our support. The mill levy will go to the vote
of the people somebody spoke that this may be a devastating effect to that maybe they are right time will
tell on those things but I just wanted to throw in my two cents that EMS typically plays a very vital role in
our community. You guys all know that we all appreciate that they have some amount of funding but they
are an enterprise fund primarily what they generate and collect is what their operating budget is. Thank
you.

Commissioner Fambro stated that the dollar amount that he suggested and he did not support lowering it
because it is still below the need to meet the hospitals presentation and business plan, they presented
months ago. This option made the most sense this hurts the elderly and low-income individuals the lease
they don't pay tax on food. The plastic bag ordinance is going to cost the residents more than this
ordinance will. It is $1.80 on $100. There are concerns about an assessment of the hospital the county can
have a third-party review and assessment but the county hasn't been in a financial position to do that and
the lease can also be revisited. There is more gross receipts tax available in 2023.
Commissioner Jim Fambro made a motion to approve Ordinance No. 2020-01, An Ordinance
adopting a County Gross Receipts Tax for the funding of operational and capital expenses of the
County leased hospital. Seconded by Tom Blankenhorn. A roll call vote was taken indicating the

Discussion: Commissioner Gallegos asked if the hospital will close if the commission does not pass the
tax or mill levy. will the hospital close. He asked someone to speak on that for the record because that is
what the public is saying there is a lot of speculation. The 3/16 is a band-aid to help the hospital grow into
the level to be self-sustaining and this is the county assisting that process. The maintenance of the
building he asked what the county can do to use reserve money to help the hospital function it is a county
building he would rather do that if that will provide a better service.
Chairman Blankenhom stated that the public hearing was closed but there is a specific request from a
commissioner he asked that Mr. Patten be sworn in.
Bill Patten was sworn in by Transcriber, Tammy Sandoval.
Bill Patten: I am the CEO at Holy Cross Medical Center, so what I have tried to say on the record is I do
not believe that Holy Cross will close. I do believe that it will look different because hard decisions will
have to be made. At the Town Council meeting last night one of the Councilors suggested that we had a
responsibility to say to the community what services that will be cut if in fact those hard decisions had to
be made but the councilor went on to say that we have been reluctant to say that because we don't want to
make the employees in those departments nervous and then artificially have recruitment retention issues.

But if you look at the services we provide and compare us to Santa Rosa for example a much smaller
L facility its easy to see what we do that they don't do but to clearly answer your question I don't believe it
will close it will look very different.
Commissioner Gallegos thanked Mr. Patten for the clarity because he has been hearing this from the
public in emails etc. it is not fair to this commission the county is here to assist as a partner as a landlord
and he wants to put language in the lease agreement to add more participation from this commission and
more accountability for both parties. He is adamant about moving forward with this he does not want to
lose jobs here he supports all of that and he wants the 3/16 managed in the best way so the staff and
public get the benefits if the county needs to come up with more money to provide a better facility then
that decision needs to be made because he has been talking about this issue here for 5 years talking about
transfers etc. EMS has concerns about transfers the timing, the hospital now has a contract with a
company for transports could that now have an impact on revenue for the county.
Bill Patten: When we looked at contracting with an outside transfer company for what we call
interfacility transfers we did that in close consultation with all EMS Departments before they went out to
RFP. They shared the RFP with EMS and reviewed responses. The solution is a good middle ground.
Commissioner Gallegos asked if the 3/16 would be able to support less transfers in the type of care that
the hospital would be able to provide. He would like to help advocate that. He wants to do everything
possible to help the hospital but everyone needs to be held accountable not putting money in and never
seeing where it goes. He wants that to be very clear.
Bill Patten: Staff has already negotiated with the union a three-year agreement and they paid out good
faith payments on last paycheck in the amount of$92,000. The mill levy and GRT is necessary there may
be a better long-term solution for the issues but these proposals the mill levy and GRT give the hospital
time to develop a longer-term regional solution because Holy Cross serves more than just Taos County. In
general,the $1.4 million mill levy money is for medical equipment and repairs on the building that's how
its been used for 3 years and the GRT for salary and benefits issues. With the projections they go upside
down by year 3 as it relates to salary and benefits but they are recognizing improvements in operations
they are having a good year and if it continues their ability to become part of the solution will help their
own bottom line. They are going to keep employees a priority and they will use GRT to make sure they
continue to get paid.
Commissioner Romero asked how the commission will address the concerns of EMS.
Commissioner Fambro said that can be addressed under a separate agenda item he will bring forth further
information later in the agenda.
Chairman Blankenhorn said the board is going to have to consider issues later for EMS but that is not
appropriate to discuss it during this public hearing.
Attorney Randy Autio stated that everything that can be discussed has been the commission can reiterate
opinions but the commission cannot get into any further details it is not part of this item. It can be
addressed in voting as an amendment to the motion and this matter can be republished.

A. New Business to be considered at a future Commission Meeting
Commissioner Jim Fambro talked about the Real ID program the MVD will be open on Saturday the New
Director of the MVD is from Taos and the commission needs to support this.
Marcos Martinez said on April 4 there will be a real race to ID day in Taos County. They will have more
staff and community and state agencies you could have a birth certificate printed on sight. There are still
about 8,000 people in Taos County that have not got a real ID.
The road fund budget was vetoed all road projects are no longer funded throughout the state.
Chairman Blankenhorn said Brent requested a special meeting on March 17, 2020 it will be a short budget
discussion for affordable housing, distress on the building and blueberry hill will be items. The
commission agreed to that date.
Vice-Chair O'Donnell said she wants the census director to give a presentation at the next meeting.
