503 TOWN OF TAGS ORDINANCES YEAR: S D NUMBER: 3 h 1 w ORDINANCE NO . 503 AN ORDINANCE TO ADOPT, W-TIFY AND CONFIRM THE DEFENSE AND DISASTER MUTUAL AID COMPACT BETWEEN THE CITY OF ALBUoUrR UE, THE CITY OF EAST LAS VEGAS, THE CITY OF SANTA FE, THE TOWU OF ESPANOLA, `SHE TOWN OF LAS VEGAS, THE TOWN OF TAOS AND THE COM- .1UNITY OF LOS ALAMOS. BE IT ORDAINED by the Board of Trustees of the Town of Taos: SECTION 1. The Town of Taos hereby sdopts, ratifies and con- firms the Compact of Mutual Aid with other cities, Lowns, villages and organized communities of the State of New Mexico, in the follow- ing terms: CIVIL DEFENSE AND DISASTER MUTUAL AID COMPACT Article 1. The promptyfull and effective utilization of the resources of the several communities of the State of New Mexico , together with such resources as may be a.veil- able from other sources, is essential to the protection, safety and welfFre of such communities and r.r' s' inhabitants in the event of e tts.ck by b ,,b.c.Le forces or other disaster however veuaed and, therefore, the purpose of this Compact is to provide e. system of mutual aid betYreen such commun- ities of the State as adopt and execute this Compact, which shall come into effect and become operative at such time as an emergency shall be declared under the -provisions of sny Civil. Defense Act in effect in this State, or upon the hap- ; pening of any disaster, whatever may be the cEuse, in any ; signatory couuaunity, which can not be adequetely met or con- trolled by the community itself. Article 2. It shall be the duty of each signatory com- So �munity to formulate civil defense plans and establish a civil defense organization 'to operate in such community and to become available for opere.tion in accordance with the provisions of this Compact. The formulation of such plans shall inedude the making of inventories of materials and equipment ava.ilEble for civil defense purposes. There shell be free .exchange of infor- mation and plans between all signatory communities . Article 3, The Directors of Civil Defense of the several signatory communities constitute a permanent committee to accum- ulate information, formulate plans a.nd take all necessary steps for the implementation of this Compact as bet-Keen the communi- ties, including the establishment of uniform standards, prac- tices and rules and regulations so far as possible and in ac- cord with those adopted by the community, State and Federal Government. Copies of all plans adopted by the committee shall be filed with the governing body of each signatory community and with the State Civil Defense Agency. Article 4, This Compact shall be limited to the exchange or furnishing of food, clothing, :medicines , emergency housing, evacuation or reception of civilian population, police services, fire fighting and rescue services and equipment, medical ser- vies, transportation services and personnel necessary to provide or conduct such services. Article �, Any signatory community which may be requested to render mutual aid by a threatened or stricken signatory com- munity shall take such action as is necessary to provide and make available the resources and services covered by this Com- pact to accordance with the purposes, intent and terms hereof, provided however, that Any community rendering aid may withhold r _ resources and services to the extent necessary for its own reasonable protection. Article 6. Any stgna.tory community requesting a.nd receiv- ing aid under thie Compact shall extend to the civil defense units or forces of the aiding community, while operating within the aided community, the se.me powers, duties, rights , privileges, and immunities as gr,,nted to oiler units or forcE:s by their own community when operating therein; provided, however, that, while the aiding civil defense units or forces will continue under 1-,heir own orgs.niza*ional command, their operational control will be exercised by the cl7il defense authorities of the community receiving assistance; and provJlied, further, that ell questions of reimbursement for compcncation, transportation, subsistence and maintenance of the aiding; units or forces, or for loss or damage to equipment furnished by the aiding community, or for expense incurred in the operation thei,eof, shall be settled and deter--mined by separate negotiation between the communities concerned subsequent to the rendition of the necessary Fid, un- less, otherwise provided by law. Article 7. This Compact shall become operative immed.istely upon its adoption and ratification by any community as between it and any other couuaunity so adopting and ratifying, Any com- munity having adopted this Compact may withdraw therefrom by takin€; the necessary legislative action and such withdrawal shall not affect the force of this Compact as between communities not withdrawing„ Article 8. For the purposes of this Compact, a signatory community shall be any community in the State of New Mexte.o, which shall adopt this Compact by ordinance or by other legal action which shall have binding effect upon such community, and •T � � l 1 5 t .. in particular` the -dommixnitiet of The City of Albuquerque$, The City of East Las Vegas, The City of Santa Fe, The Town of Espanola, The Town of Las Vegas, The Town of Taos, and, The Community of Los Alamos. Article g. The provisions of this Compact shall be sub- ject to and limited by the provisions of any Civil Defense Act in force or which may be put in force in the State of New Mexico. SECTION L.
