An Ordinance providing for the assessment and collection of a special tax of
one cent per package upon cigarrettes sold within the Town of Taos; providin;-
penalties for non-payment of such tax; and, limiting the use of money derived
from -uch tax to recreational purposes,
FE IT ORDAIT;TD by the Foard of Trustees of the Town of Taos,t'ew 1:ex-
ieo:
Section 1. Tax. Feginnning with the Ist,of Aul,ust, 1952, there
shall be payt-le to the 'lows of Tans by every person, firm, corporation or
association sel l i-nr• r;-arettes within thr corporate limits of the Town: of Taos,
as the sa�;,e now exist or may hereafter be extended, a special tax, on each xnd
every packal,e of arettes sold therein, on and after such above mentionr�d

a. Five (5) mills on each package of ten (10) cigarettes,or less -
h. One (1) cent on each package of more than ten (10) cigarettr-�
and no more than twenty (20) cigarettes;
c. An additional Five (5)4 ni.11s for each ten (10) cigarettes or
less, over twenty (20) cigarettes, in any one package.
All cigarettes taxe(i tnr this Ordinance shall he put i.n packages or con-
tainers, and on each of said packages or containers shall be afixed an
official stann, denoting the wor(Is, tobacco tax and the corresponding tax the-

of the package or container.
Section. 2. Time of Payment. Such tax shall t)e payable monthly on or

a. From and after the effective date of this Ordinance,
no person shall ongage in or conduct the business of

such stamps to each and every package of ciCarettes coming; =nto
their posse«i nr_, before maki.nt the first sale thereof. All drop
shipments of cigarettes shall likewise be so stamped by the dis-
tritnetor before beig,•n delivered to receipient thereof.
It shall be unlawful for any wholesale, retailer or consumer to purchase
or acquire ciCarettes or tobacco >>pon which the stamps provided for in
this Ordinance have not been affixed.
Section. 5. Penalties for ?violation. Any person,firm, corporation or
association viol:t-ngr any of the provisions, of this Ordinance by failing
to file the report or pay the tax, as herein provibed, shall, upon con-
viction thereof, be fined not 7 PFs than fifty dollars (50.00),nor more
than two huh_?r-3 dollars '200.00),0), for each offense, and the Court trying
said case and imposing; such fine shall have no pourer to suspend such fine.
Section 6. Definitions.
a. The word "ci`arette", as used in this nrdi.nance, shall mean
all rolls cf tobacco or an�r substitute therefor,wrapped in
Raper.
b. The ten„ "tobacco" shall mean the leaves of the various va-
rieties of the tnhacco plant prepared i.n various processes
of manufacture and made into casarettes intended for smoking;.
Section 7. Recreational Pro,,ram. The manner of stablishing;,
maintaining; and carrying; out the Recreational Pro-ram contemplated 1Yy
this Ordinance shall be as the Board of Trustees shall., from time to
time, by Resol-.iti_on duly adopted provi le, provi;_iins,however,that such
E,oard of Trustees may, in their discreation:
a. Provide for and appoint a Recreational t'oarl of five, or less,
competent persons,residents of the Town of Taos,who shall ser-
-ire without compensation,to formiil.ate and carry out such recrea-
tional proc-ram,each member to serve for such lenL;th of tine as
the poard of Trustees shall determine.
b. Authorize such Pow d to adopt 15r-laws governing; the activities
of such Board and to formulate rules for the furtherance of
such recreational pro .ram, subject to the supervision of the
Poard of Trustees.
C. Authorize suc., P.oard to desi,,nate an official treasurer, who
shall receive monthly,from the Town Clerk, or at such other
time as the Eoard of Trustees determines,the tax pa'-.d in
under the direction of the committee, Such Treasilrer to be
bonded in a sum not less than 31,000.00.
d. Authorize such Board to employ a competent Recreational Director
at such salary as the Board of Trustees may determine.

Section 4. Method of Collection.

a. Provide for and appoint a Re-
creational Board of five, or leap,
competent persons, residents.of
the Town of Taos, who shall
serve.without compensation, to
formulate and carry out such
recreational program,each mem-
member'to serve for such length
of time as the Board of Trustees

b. AuthOrize i0cu Doard to adopt V
by-laws governing the activities
of such Board and to formulate
rules for.the furtherance of such
recreational program, subject to
thet supervision of the Board of r`
Trustees.
c. Authorize such Board to desig- j:
mate an official treasurer, who
shall receive monthly, from the
u Town Clerk, or at such other ,
time as the Board of Trustees
determines, the tax paid in un-
der the direction of the Com. x
mittee. Such Treasurer to be
bonded in'a sum not less than
$1,000.00.
d. Authorize such Board to em-
ploy a competent Recreational
Director at such salary as the
Board of Trustees may deter-
mine.
i e. Provide for the removal of any
of the members of said Board,
for cause, and the manner of
filling vacancies thereon.
f. To do any and all other things
necessary and expedient to the
carrying out of the purposes of
this Ordinance.
