ITINERANT PORTRAIT OR COMMERCIAL PHOTO-
GRAPHY AND SUCH RELATED ACTIVITIES 'AS
(� ENLARGING, COPYING, COLORING AND PORTRAIT
FINISHING OF PHOTOGRAPHS, CONDUCTED OR
i; SOLICITED WITHIN THE TOWN OF TAOS.
Be it ordained by the Town Council of the Town of Laos, as follows:
Section 1: It shall be unlawful for any person, firm or corporation to
engage in the business, occupation or profession of resident, transient or it-
inerant portrait or commercial photography, or in the enlarging, copying, color-
ing or portrait finishing of photographs, or to solicit or offer for sale any
of such goods or services, directly or indirectly, verbally, by telephone, by
mail, through the use of coupons or tokens of whatever nature. or by means of
printed advertising of any form, by subterfuge or otherwise, in the Town of
Taos without first having procured a license therefor from the Town Clerk of
the Town of Taos, as hereinafter provided.
Section 2: The license fee for any person, firm or corporation so engaged,
whether resident, transient or itinerant, shall be Thirty-Five Dollars ($35.00)
per annu,7i or any fraction thereof, and in addition a license fee of Five Doll-
ars($5.CO) per day or any fraction thereof shall be paid by such person, firm
or corporation for each outside solicitor or salesperson, including solicitors
or salespersons so employed but operating from their own temporary or permanent
residences or telephones and whether paid on a salary or commission basis, con-
tracted with ,,r employed by such person, firm or corpoation for the purposes of
selling, distributing or securing orders for portrait or commercial photographs,
or for the enlarging, copying, coloring or portrait finishing thereof, or for
the selling or distribution of coupons or tokens, or other printed or similar
offers or advertising literature pledged or used in the sale of portrait or
commmercial photographs or the enlarging, copying, coloring or portrait finish-
ing thereof.
Section 3: Before said Clerk shall issue any license to any person, firm
or corporation proposing to engage in the business, occupation or profession
of resident, transient or itinerant portrait or commercial photography, or in
the enlarging, copying, coloring or portrait finishing of photographs, such ap-
plicant person, firm or corporation shall execute an indemnity bond in the
amount of rive Hundred Dollars ($500.00) to the Town of Taos for the use and
benefit of the patrons of said person, firm or corporation who are residents of
Taos, and which bond Shall be approved by the : ar or the Town of Taos as to
form and security. Said bond shall have as surety either a regularly licensed
corporate surety company or a resident and real property owner of Taos County,
New Mexico, who shall be worth at least the sum of One Th >usand Dollars ($1000)
above his debts and exemptions in property subject to execution and sale, and
who shall make an affidavit to that effect before signing as surety. In lieu .)f
surety, Five Hundred Dollars (w500.CO) in cash may be deposited with the Town
Clerk of the Town of Taos, to be returned without interest by the Clerk to the
applicant within thirty (30) days after the end of the license period or any
renewal period thereof should such license be renewed. The applicant shall
further appoint the Town Clerk of the Town of Taos as his process agent in all
matters connected with or arising out of said appllcant's business, occupation
or profession of portrait or commercial photography, or the enlarging, copying,
coloring; or portrait finishing of photographs, or the solicitation or offering
for sale thereof, whether by the applicant or by his agents, sub-contractors or
employees in the Town of Taos, before obtaining such license. It shall be the
duty of the Clerk immediately 'Uo advise the applicant by registered mail, ad-
dressed to said applicant at his place of business at the address furnished in
the indemnity bond, of the nature and pendency of any action brought against
said applicant wherein process is served on the said Clerk.
Section 4s Any person, firm or corporation violating any of the terms or
provisions of this ordinance shall be fined not less than Twenty Dollars ($20.00)

Section 5: All ordinances or parts of ordinances of the Town of Taos
which are in conflict herewith are hereby repealed.

Section 4. Any person, firm or corporation violating any of the terms of
provisions of this ordinance shall be fined not less than Twenty Dollars,
(020.00) nor more than Five Hundred Dollars (;P500.00) for each such offense,
and each day's violation of this ordinance shall be considered a separate
offense.
Section 5. All ordinances or party of ordinances of the Town of Taos,
whicF are in conflict herewith are hereby repealed.

tinent Ordinance of he Town of Taos, New L,exico, and in order to enable the ap-
plicant to be licensed as photographer in the Town of Taos, New Mexico,, do here-
by jointly and severally undertake and agree to indemnify any customers or pa-
trons of the applicant, or of the applicanylt agents, or sub-contractors, against
any damages, not to exceed Two Hundred Fifty Dollars (:;x250.00) in the aggregate,
resulting from failure of said photographer or his agents or sub-contractors to
perform in full any contracts or promises made relative to photographs, color-
ing, or enlarging done in the Town of Taos, and which may be established by the
final judgement of a court of competent jurisdiction. Any such judgement may be
satisfied by execution against cash deposit in the hands of the Clerk, or by pro-
ceeding against the applicant or his surety, or both. The Town Clerk of Taos is
hereby appointed by the applicant as his process agent for any litigation filed
in Taos County, New Mexico, connected with or arising out of photography, color-
ing, enlarging or finishing photographs by the applicant, or by his agents or
sub-contractors in Taos, New Mexico.
