602 TOWN OF TAOS ORDINANCES YEAR: NUMBER: 60,1 ORDINANCE NO. 602 AN ORDINANCE CREAT.T,NG THE OFFICE OF TOWN MANAGER, SETTING FORTH METHOD OF APPOINTMENT, QUALIFICATIONS, DUTIES AND FACTORS RELATIVE TO THE OFFICE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF TAOS , AS FOLLOWS : Section 1 . Creation of Office . There is hereby created the office of town manager of the Town of Taos . Section 2 . Appointment and Selection Genev;i.11y. The town manager shall be appointed by the Mayor • ith the consent of a majority of all of the members of the Lown Council, and shall be selected and appointed solely on the basis of his training, experience and other qualifi- cations for office as hereinafter prescribed without regard for affiliation, or lack of affiliation, with any political party or other organization of whatsoever nature . Section 3 . Appointment and Duties of Selection Committee . The Mayor shall appoint a selection committee composed of council members , whose duty it shall be to advertise the position nationally through recognized channels and who shall recommend to the Mayor and Council individuals who meet the qualifications for the office . Section 4. Limitation on Appointment of Elective Officer of Town as Town Manager. No elective officer of the Town shall be appointed town manager during the term for which he shall have been elected nor within one year after the expiration of his term. Section 5 . Qualifications . The town manager shall be over thirty years of age ; shall have a college degree in business administration, or some other field allied to muni- cipal administration, and shall have had two years ' experience in one of such fields in an administrative capacity or shall have had a minimum of two years of college plus a minimum of five years ' experience in governmental administration in an executive capacity, preferably in or under a city manager government . Section 6 . Term. The town manager shall be appointed for an indefinite term. Section 7 . Oath; Bond. The town manager shall take the oath prescribed by law and shall furnish a surety bond in the sum of twenty-five thousand dollars to be approved by the council . Such bond shall be conditioned on the faithful performance of his duties . The premium of the bond shall be paid by the Town. Section B . Compensation. The town manager shall receive compensation as the council shall fix by resolution. cn sxvn M111111kAL'NTC I -_ - 0 Section 9. Procedure for Removal. The Mayor may, with the consent of a majority of the entire council, remove the town manager from office pursuant to the procedure pres- cribed as follows : An accusation in writing and sworn to specifying in detail the grounds for removal shall be filed with the town clerk in triplicate . Upon such filing the town clerk shall immediately transmit one copy to the Mayor and one copy to the town manager . Upon receipt by him of the accusation the Mayor shall forthwith refer the same to a committee of council members appointed by him for investi- gation of the grounds of the removal charged. The committee shall render a report of its investigation with its recommenda- tions to the Mayor and town council at the next regular meeting of the council; provided that not less than two weeks shall elapse between the date of filing the accusation and date of such meeting . Upon the presentation of the report and recommendation of the investigating committee the council shall, by resolution adopted by a majority vote of the whole council, act upon the recommendation of the committee . In the event probable cause for the removal is not found to exist the accusation shall forthwith be dismissed . In the event probable cause for removal is found to exist, final hearing on such accusation shall be had at the next regular meeting of the council. The town manager shall be given opportunity to be heard and if he requests a hearing shall be heard at such meeting . After such public hearing, if one be requested, and after full consideration, the council, by majority vote of its members , may adopt a final resolution of removal . By the preliminary resolution the council may sus- pend the manager from duty, but shall, in any case , cause to be paid him forthwith any unpaid balance of his salary, and his salary for the next two calendar months following adoption of the preliminary resolution. Section 10 . Town Manager Pro tem; Filing of Vacancy in Office. During any temporary absence or disability of the town manager, or during any period when the office of town manager has ziot been regularly appointed, the Mayor shall appoint a qualified town officer or employee to temporarily perform his duties until the town manager returns on the termination of his disability or until a regularly selected town manager shall have been appointed. Any vacancy in the office of town manager shall be filed by appointment of a regularly selected town manager within sixty days after the effective date of such vacancy. Section 11 . Relationship with Mayor and Town Council . The town manager shall be responsible to the Mayor and town council for the efficient administration of all branches and departments of the town government. The Mayor and members of the town council shall deal with department -2- rn� ain���i.�r�rn�nrn heads and employees of the town solely through the town manager . Neither the Mayor nor any member of the town council shall give any order directly to any department or employee, either publicly or privately. Section 12. Duties and Authoriity Generally. It shall be the duty of the town manager, and he is hereby given the necessary authority: (a) Generally. To coordinate and supervise the activities and operations of the various branches and departments of the town government and to efficiently manage the administrative affairs of the town. (b) Carrying Out of Programs, etc. ; Enforcement of Ordinances, etc . To expeditiously and efficiently carry out the programs and policies adopted by the town council and cause to be enforced all ordinances of the town and regulations adopted by the town council . (c) Attendance at Council Meetings ; Vote . To attend all meetings of the town council and of committees thereof and participate in the discussion of all matters pertaining to the administration of town affairs coming before the council or such committees , but he shall not have the right to vote . (d) Budget. To assist in the preparation of the annual budget. (e) Reports , etc. to Council. To keep the town council informed of the financial condition and of the needs of the town and to render reports with respect thereto and with respect to all other town affairs at such times and in such form as may, from time to time, be prescribed by the council, accompanied by such recommendations as he may deem advisable. (f) Formulation and Recommendation of Measures for Adoption. To formulate and recommend to the Mayor and town council the adoption of such measures as he may, from time to time, deem necessary or advisable for the health, safety and welfare of the town and its inhabitants or for the improvement of administrative or departmental functions and services. (g) Purchases . To make recommendations with res- pect to the purchase, in behalf of the town of its departments , of materials, supplies and equipment and to supervise the making of such purchases when and in the manner authorized by the town council . Section 13 . Powers and Duties of Departmental Administrative Officers Under Supervision, etc. All admini- strative officers of the departments of the town government heretofore or hereafter appointed shall continue to have supervision of and to be responsible for the activities and operations of their respective departments , subject, -3- however, to the general supervision, control and direction of the town manager as prescribed in this section. Section 14. Service as Departmental Administrative Officer. The town manager may, upon appointment by the Mayor and confirmation by a majority of the whole council, serve as the administrative officer of one or more depart- ments . Section 15 . Appointment, Removal, etc. of Officers and Employees . Z enever it becomes necessary to employ or appoint any person to fill a vacancy in any departmental administrative office or position of employment, the town manager shall submit to the Mayor the name of a person qualified for the office or position to be filled. No appointment to any office or position shall be made with- out the town manager ' s recommendation, except by the vote of a majority of the entire council. The town manager may recommend the removal or sus- pension of any town official or employee when such action woiml.d be in the best interests of the town_ and the Mayor and town council shall give full weight to the town manager ' s recommendation. All i:ecommendations for appointment, removal or suspension shall be based solely on the merit, qualifications or disqualification of the officer or employee concerned, without regard to race , color or creed or to the affiliation or lack of affiliation of any person with any political party or other organizations whatsoever. In all matters pertaining to appointments to or removal from the police department, the provisions of town ordinances will be followed. Section 16. Engaging in Political Activity. The town manager shall not either directly or indirectly engage in partisan political activity, in any manner, while in office . Section 17. Financial Interest in Contracts , etc. The town manager shall have no financial interest in any contract or financial transaction with the town.
