AN ORDINANCE ENTERING INTO AGREEMENT WITH THE
STA'L'E OF NEW MEXICO
HE IT ORDAINED BY THE GOVERTIUNG 13ODY OF THE TOWTN OF TAOS:
Section 1. That tl;e town of Taos does hereby accept al]. terms,
conditions and obligations there=in and thereby imposed by the agreement
governing the installation, operation and maintenance of a low frequency
non-directional radio tr.ansi-Atter located at or near the Taos Municipal
Airport.
Section 2. That said agreement governing the installation, operation
and maintenance of a lo:a frequency non-directional radio transmitter at
or near the Taos Municipal Airport so adopted is as follows:

BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF TAOS:
Section 1. That the town of Taos does hereby accept all terms,
conditions and obl .gations therein and thereby imposed by the agreement
governing the installation, operation and maintenance of a low.frequency
non-directional radio transmitter located at or near the Taos Municipal
Airport.
Section 2. That said agreement governing the installation, operation
and maintenance of a low frequency non-directional radio transmitter at
or near the Taos Municipal Airport so adopted is as follows:
Regular meeting held on February 16th, 1971.
Motion by Mrs. Lucille Pond, seconded by Mr. Martin Vargas. Motion carried
unanirdously.
Section 3. That by this ordinance the town of Taos authorizes its
mayor acting as its representative to execute and accept this agreement
in behalf of the town of Taos.
Section 4. That this agreement, having been duly approved by the
governing body of the town of Taos, shall constitute a part of the
Ordinances of the Town of Taos, and shall be recorded in the manner
prescribed by Sections 14-16-1 through 14-16-5, N.M.S.A. , 1953 Compilation.
PASSED AND ADOPTED BY THE TOWN COUNCIL OF THE TOWN OF TAOS, NEW MEXICO,
AT A REGULAR MEETING THEREOF HELD ON THE ��! DAY OF , 197&
AND APPROVED BY THE UNDERSIGNED MAYOR ON SAID DATE AND ORDERED TO BE
PUBLISHED AS REQUIRED BY LAW.

AGREEMENT
STATE OF NEW MEXICO
COUNTY OF TAOS
THIS AGREEMENT made and entered into by and between the state of New

Mexico, acting through its Aviation Board, party of the first part,
hereinafter known as the "State," and the Town of Taos, party of the
second paLt, hereinafter known as the "Town," to govern the installation,
operation and maintenance of a low frequency non-directional radio trans-
mitter, hereinafter known as the "Transmitter," to be located at or near
the! Taos Municipal Airport.
WITNESSETH:
Section 1. That the State shall furnish at no expense to the Town the
Trannsmitter, an approved monitor, and spare parts necessary for certification
by the Federal Aviation Administration.
Section 2. That the Town shall assume the responsibility and bear the
expenses for:
A. the installation of the Transmitter;
B. the construction of a suitable antenna and necessary appurtenances;
C. the continuous operation of said Transmitter;
D. the continuous monitoring of said Transmitter; '
E. all necessary maintenance;
F. all other requirements necessary for the certification and continuous
operation of said Transmitter.
Section 3. The Town further agrees that it will:
A. provide a site suitable for the installation of said Transmitter and
necessary appurtenances;
B. operate said Transmitter for the benefit of and use by the general
public without discrimination between types, kinds or classes of aeronautical
use, or against any person or any class of persons for reasons of race, color,
creed or national origin;
C. comply with all Federal or State rules and regulations governing the
operation of such a facility;

D. That such facility and all records pertaining to the operation
thereof, shall be available to and for inspection by representatives of
• the State or Federal Aviation Administration;
E. return in good condition to the State all equipment furnished
thereby' in event the Town defaults on this agreement or if this agreement
is otherwise terminated.
This agreement shall be in effect from the date hereof and shall
continue in full force and effect until terminated by either party upon
three months written notice..

DEMING We recaived copies of an Ordinance No. 607 and agreement
BOB WHITE from the Town of Toas relative to the installation of a
DIRECTOR non-directional radio transmitter. This ordinance was
adopted February 16, 1971.
We would like to have the agreement with the original
signatures for our files. We would appreciate it if
you could get this for us.
