AN ORDINANCE PROVIDING FOR THE ADOPTION BY REFERENCE OF THE NEW MEXICO UNIFORM BUILDING CODE 1976 EDITION OF THE UNIFORM BUILDING CODE; PROVIDING PUNISHMENT FOR VIOLATION THEREOF; AND PROVIDING THAT COPIES OF SAID CODE SHALL BE MADE AVAILABLE AT THE OFFICE OF THE CITY MANAGER; WHEREAS, the health and welfare of the public requires the regulation of the construction, maintenance, etc., of buildings in the Town of Taos by the adoption of a building code; and WHEREAS, Section 14-16-5 of The New Mexico Municipal Code, Chapter 300 of the Laws of 1965, provides that a municipality may adopt by ordinance the conditions, provisions, limitations and terms of a building code and that said cede may be adopted by reference thereto: THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF TAOS, NEW MEXICO: SECTION 1: New Mexico Uniform Building Code - Adoption. There is hereby adopted by the Town of Taos, so far as it is not in conflict with laws of the State of New Mexico, or rules and reg%Llations of the General Construction Board of New Mexico, for the purpose of regulating the erection, construction, enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment, use, area and maintenance of buildings or structures in the Town and for the purpose of providing for the issuance of permits and the collection of fees, that certain code known n s The New Mexico Uniform Building Code, which was adopted by the General Construct- ion Board and accepted by the Construction Industries Commission, and which is also known as the Uniform ':wilding Code, 1976 Edition. The Town does hereby adopt the above mentioned code in its entirety, and any amendments or changes thereto, including any and all new editions thereof, and the some is hereby A adopted and incorporated as fully as if set out verbatim herein. SECTION 2: Punishment for Violation of the Code. Any person violating or failing, neglecting or refusing to comply with the provisions of this New Mexico Uniform Building Code shall be punished by a fine of not less than $5.00 nor more than $300.00 or by imprisonment for a term of not less than five (5) days or more than ninety (90) days. Every day any violation of this code shall. continue, shall constitute, except where otherwise provided, a separate offense. SECTION 3: Copies to be Available and subject to Inspection. One or more copies of the New Mexico Uniform Building Code, adopted in Section 1 of this Ordinance shall be available and subject to inspection at all reasonable times in the Office of the Town Manager in the Town Hall. SECTION 4: Effective Date. This Ordinance shall take effect and become operative on the 15th day of February, 1978.
