NOTICE OF MEETING AND PROPOSED ORDINANCE
The Taos Town Council of the Town of Taos (herein the "Town") , New Mexico
hereby gives notice of its intention to hold a special public meeting at 5:15
P.M., on Thursday, October 12, 1978, at the Taos Town Hall, Armory Street,
Taos, New Mexico. At such meeting the council will adopt an ordinance relat-
ing to controlling the provisions of municipal water services to the users
thereof within the Town of Taos. The title and subject matter of such pro-
posed ordinance is as follows:
AN ORDINANCE CONTROLLING THE PROVISIONS OF
MUNICIPAL WATER SERVICES TO THE USERS THEREOF
WITHIN THE TOWN OF TAOS, NEW MEXICO AND-.THE
SERVICE AREA THEREOF.
The following is a general summary of the subject matter contained in
Ordinance No. 653:
Section 1 deals with the requirements for municipal water services.
Section 2 deals with the conditions and transfer of water rights to
the Town of Taos for new municipal water service connections.

Council approved and adopted Ordinance No. 653 an ordinance relating

WHEREAS, the demands for And ursge of municipal water services have in-
creased substantially until demand ;nas exceeded the Town's diversionary water
rights, and

WHEREAS, population estimates for -`:he Town of Taos during the future re-
flect greater increases in population with limited means of acquiring the

( needed water to supply the increased demand, and

WHEREAS, municipalities are allowed by State law to acquire, contract for '
or condemn springs, wells, water rights, other water supplies, and right of
,,way or other necessary ownership for the acquisition of water facilities,

NOW THEREFORE, be it ordained by the governing body of Taos, New Mexico:

Section 1. REQUIREMENTS FOR MUNICIPAL WATER SERVICES.
I
Any person, firm, corporation or association, hereinafter referred to as
"user", who shall request municipal water services shall hereafter be required
;s
to transfer water rights to the Town of Taos in exchange for such services
under the conditions contained herein and in the amounts which shall be deter-
'; mined by the governing body of Taos, New Mexico by Resolution duly adopted from
time to time.
Section 2. CONDITIONS.
No new municipal water service connection shall be approved by the Town
; of Taos, New Mexico for any user until there has been a completed transfer to
,
the Town of Taos water rights as shall be required by the governing body of
: Taos, New Mexico according to an Annual Water Allotment Schedule in such resolu
tion based on annual average consumption for like establishment/enterprises.

" The requirements stated herein for transfer of water rights shall be re-
stricted to new municipal water service connections as opposed to reconnection
: or renewal of terminated services, unless the type of establishment changes to
i
a higher use in which case the difference between the previous use and higher j
use must be transferred.
The amounts required to be transferred under the schedule of terms shall j
,be on an acre-foot consumptive use basis and contigent on approval for trans-
fer to the Town of Taos under the rules, regulations and procedures required
sand in compliance with State water laws; all costs in connection with such
,.transfer shall be borne by transferor.
Water rights transfers based on an Annual Water Allotment Schedule
' established by Resolution shall be required for new sub-divisions approved
i
,! under the Town of Taos sub-division regulations.
All future annexation will be considered upon submittal of a Water Plan
consistent with this Ordinance and approved only after water rights have been
transferred to the Town of Taos in the amounts determined necessary to provide
municipal water services in the said area to be annexed.
Transfer of water rights, where applicable, will be required for parcels
of land on which building permits are issued.
That the transfer of water rights wherever applicable, in no way abolish-
es requirement of tapping fees or other requirements of the Town of Taos, re-
garding the water system.
Other municipal water service users presently using the Town water system
will be encouraged to transfer to the Town of Taos any and all water rights
, they now own or hereinafter acquire, and
All owners of water rights within the Town of Taos and its service area
will be encouraged to continue to use any and all irrigation rights beneficially
so

more water on per unit basis than one without such facil-
ities. Adjustments on an individual basis shall be made
for any establishments which may deviate significantly from

BE IT FURTHER RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TAOS, NEW
MEXICO, that in the event that the required water rights cannot be transferred
jito the Town and if the Town has sufficient water rights available, the Town may j
j1allow the proposed water service connection upon payment in cash of $2_,000.00
a;
per acre foot of water rights needed on a consumptive use basis. Nothing in
I11this Resolution shall require the Town to sell any of the water rights it may
j(own.

l� WHEREAS, it is the desire of the Town to establish such a schedule, and
WHEREAS, no new municipal water service connection shall be approved by '

11rights to meet a minimum requirement or schedule based on annual average con-

it WHEREEAS$ there may be situations wherein the proposed water sewer con-
jnector cannot furnish the required water right and a money amount should be
ijestablished in lieu of the required water right,
