Juvenile Detention 1 Delfino Torres and Mary Martinez Mr. Torres stated that the $70,000 figure quoted i a prior meeting was too low, 1 I reason being that instead of three walls, four are ;;oing to be needed. These regula- tions are passed, adopted and approved by the Joint Municipal/ County Zoning Authority of the Town of Taos and County of Taos, New Mexico, as an amendment to the Town of Taos Zoning Ordinance. BE IT ORDAINED BY THE JOINT MUNICIPAL-COUNTY ZONING AUTHORITY OF THE TOWN AND COUNTY OF TAOS, NEW MEXICO: Section 1 : A new Section of the Town of Taos Zoning Ordinance is added to read: HCP - HIGHWAY CORRIDOR PROTECTION DISTRICT A. Intent and Purpose - This zone is intended to permit the safe and orderly development of commercial uses and ser- vices along the major roads leading in and out of the Town of Taos for the retailing of goods and services to local residents and passing motorists in a manner which retains the archi'tecturai style of the Taos Valley. It is not the intent of this district to encourage or facilitate strip commercial development areas. B. Uses Permitted - Any use not specifically excluded by the prohibited and conditional uses sections are allowed within the HCP District upon review of the Extra- territorial Zoning Commission. C. Prohibited Uses - a. Mobile home sales b. Drive-in theaters C. Freight or express terminals d. Heliports e. Manufacturing - Excluding Arts and Crafts (.as listed under conditional uses or any concern employing more -1- t n ! t t 4 than five employees. ) f. Junk yards auto salvage yards. D. Conditional Uses - a. New residential development b. Arts and crafts retail shops and related production or manufacturing with up to five (5) employees, if such related production can be conducted within the confines of a structure or enclosed yard and all performance standards are met. E. Uses Requiring Special Use Permits (See RA Zone Taos Zoning Ordinance) F. Development Standards a. Planned Unit Development (PUD) 1 . Maximum overall population density - with ¢ k i use approval , up to 14 dwelling units per acre. 2. Minimum PUD size i acre. 3. See PUD standards in Town of Taos Zoning Ordinance. b. Standards for non-PUDS 1 . Minimum lot requirements: Other than the minimum lot size requirements as established by the New Mexico Environmental Improvement Division for individual water and waste water treatment facilities, there are no minimum lot requirements. Any parcel, of one acre or more in size must be processed through the Planned Unit Development Standards. 2. Lot Width: Minimum required lot width shall -2- tF be eighty (80) feet. 3. Minimum Setback Requirements: Front Yard: Structures - 40 feet from high- way right-of-way. Off-Street Parking - 25 feet The front 15 feet of the lot shall be landscaped in accordance with the pro- visions of the Town Ordinance adopted providing for landscaping. Side: Structures twenty (20) feet from the lot line twenty (20) feet, except on the rear of a lot abutting a dwelling district, in in which case there shall be a rear yard of not less than 25 feet or 20% of the depth of the lot, whichever is least. 4. Maximum Lot Coverage: 40% by all structures 5. Maximum Building Height: No building shall exceed 24 feet in height from the highest point of the surface of the ground at the peri-meter of the building except for flag poles, antennas or chimneys which are exempted from this height limitation. 6. Minimum off-Street Parking and Loading Requirements: a. Off-Street Parking: The Town ordinances adopted providing for the requirements. b. Off-Street Loading -3- C All permitted or permissible uses requiring loading space for normal operations shall provide adequate loading space, at the rear of the building where appropriate, so that no vehicle being loaded or unloaded in connec- tion with normal operations shall stand in, or project into, any public street, walk, alley or way. G. Performance Standards: a. Traffic generation: The amount of traffic generated by the Devel- opment shall not at any time impede traffic flow, or cause a public road to operate at over capacity. Adequate and safely marked ingress and egress points are required for each Development: The shared use of ingress and egress points by two or more Developments is to be encouraged. b. Performance Standards: The proposed Development shall utilize standard techniques available to the use involved in order to minimize noise, vibration, smoke and other particulate matter: odorous matter: toxic or noxious matter; radiation hazards, fire and explosion hazards or electromagnetic interference. The Code Administrator may refer an application to the New Mexico Environ- mental Improvement Division for comment concerning the performance standards. -4- a i' H. Design Standards: a. Sign Regulations: The Town Ordinance adopted providing for sign regula- tions are hereby incorporated and made part of this Ordinance. b. Landscaping Guidelines: The Town Ordinance adopted providing for landscaping guidelines, are hereby incorporated and made part of this Ordinance. C. Architectural Guidelines: It is the intent of this section to provide architec- tural guidelines to retain the traditional design qualities found in the Taos Valley while encouraging creativity, inventiveness and flexibility in the design of new or altered building. 1 . Building Height: Building shall be limited to a maximum height of 24 feet from the :; gh- est point of the surface of the ground at the perimeter of the building. 2. Proportions: Proportions, in general , are long and low in the Taos Valley although buildings in the area tend to be somewhat more vertical than in other parts of Northern New Mexico because of the influence of Taos Pueblo. 3. Roof Types: The flat roof is predominant in the Taos Valley. Although it is important that a roof typical for the style of building be designed. 4. Color: Generally most of the buildings in the -5- Aft Taos Valley are earth colored to simulate adobe with mud plaster. Decisions on color should be based on the relationship a new or renovated building has to its design. I. Building Ordinances and Fire Codes 1 . The Town Ordinances adopted providing for cunformance with the State of New Mexico Uniform Building Code and all of its supple- ments thereto including provisions for occu- pancy permits. 2. Fire prevention and life safety code N F P A 101 , Flammable and Liquid Combusion code N F P A 385 and N F P A 30, as adopted by the Town of Taos. Section 2: A new Section of the Town of Taos Zoning Ordinance is added to read: ARO - AGRICULTURE-RECREATION-OPEN SPACE DISTRICT A. Intent and Purpose This zoning district is intended to permit uses incidential to the agricultural , recreation and open space characteristics of the district. To protect the purpose of this district, all permitted developments shall be subject to Planned Unit Development (.PUD) require- ments (See PUD requirements Town of Taos Zoning Ordinance) B. Uses Permitted - The following uses are allowed in the Agriculture-Recreation-Open Space District, a. Agriculture b. Archery C. Campgrounds d. Driving Range -6- fh , F e. Public parks, playgrounds and play fields f. Stables (riding) C. Permitted Accessory Uses and Structures - Uses and structures which are customarily accessory and clearly incidental to permitted uses and structures. D. Prohibited Uses and Structures - Permanant industrial , commercial and residential structures and every use not specifically allowed. E. Special Exceptions - After a public hearing, other uses may be permitted under a special exception, if in the opinion of the Extra-territorial Zoning Commission, the proposed use is not offensive or imcompatible with the character of the district. F. Development Standards a. Planned Unit Development (PUD) 1 . See P'JD Standard in section of the Town of Taos Zoning Ordinance. 2. Minimum PUD size - 2.5 acres B. Standards for Ikon-PUDS 1 . All permitted developments shall be subject to Planned Unit Development requirements. Section 3: A new section of the Town of Taos Zoning Ordinance is added to read: RA RESIDENTIAL AGRICULTURE A. This zoning district is intended to promote and encourage a suitable environment for single family residential use on large parcels of land where extensive demand for urban develop- ment has, as yet, not been made, to promote f6r a low density of population compatible with a rural farm environment and in which the extension of community water and sewer is precluded. -7- To ,.;1oKct the purpose of this district,all permitted developments shall be subject to Planned Unit Development (PUD) requirements (See PUD requirements, Town of Taos Zoning Ordinance) and the residential - agricultural zone provisions of the Town of Taos Zoning Ordinance. Section 4: A new section of the Town of Taos Zoning Ordinance is added to read: ESTABLISHMENT OF ZONE BONDARIES A. The location and boundaries of the various Extra-territorial zones hereinafter determined shall be shown on an official Extra !territorial Zoning Map, attached to this Ordinance and marked exhibit "A" and incorporated herein by reference. The original of said map shall be kept in the office of the Town's Building Inspector. Section 5: A new section of the Town of Taos Zoning Ordinance is added to read: DEJERMINATION OF BOUNDARIES AND ZONES A. The boundaries and zones in the Extra-territorial Zone shall be determined by recommendation of the Extra-territorial Zoning Commission after public hearing, to the Joint Municipal - County Zoning Authority who may then adopt the same at a public hearing. Section 6: A new section of the Town of Taos Zoning Ordinance is added to read: ENFORCEMENT, PENALTIES, VARIANCES, CHANGES IN BOUNDARIES, CHANGES IN ZONES, AMENDMENTS A. All procedures for changes in zones and boundaries, enforcement, penalties, amendments, supplementing or repealing this ordinance and all other procedural matters shall be handled pursuant to the Planning and Zoning Codes then enforced and adopted by the -8- Town o f aos. EXTRATERRITORIAL ZONING COMMISSIO THAT the Council and the Commission do hereby establish an Extraterr- torial Zoning Commission consisting of two members appointed by the Town Council , and two members appointed by the Commission , said members shall be appointed by the Town Council and Commission within thirty working days of the adoption of this Agreement. THAT the four Extraterritorial Zoning Commission members appointed by the Town Council and the County Board of Commissioners shall appoint one addition- al member from an area of the County that is neither within the zoning juris- diction of the Town nor within the area of the County affected by the proposed Extraterritorial Zoning Ordinance. Said member shall be appointed by a ma- jority vote of Ehe members appointed to the Extraterritorial Zoning Commission by the Town Council and the County Board of Commissioners and shall be appoint- ed within thirty working days of the appointment of the Extraterritorial Zoning Commission members by the Town Council and County Board of Commissioners. THAT following the appointment of the fifth (5th) member to the five member Extraterritorial Zoning Commission, the Extraterritorial Zoning Com- mission, within three hundred sixty (360) days, shall recommend to the Joint Municipal-County Zoning Authority a Zoning Ordinance applicable to all or any portion of the extraterritorial zoning area. The Ordinance shall pro- vide for the manner in which zoning regulations, restrictions, and boundaries of the districts are determined, established , and enforced; and amended, supplemented or repealed. THAT the extraterritorial zoning ordinance shall be administered by the Planning Coordinator or agent of the Town of Taos, who shall , for purposes of such administration, report to and be responsible to the Extraterritorial Zoning Commission. THAT members of the Extraterritorial Zoning Commission shall serve at the pleasure of the body appointing them and shall be appointed for terms of one year and sha' ' administer the Zoning Ordinance adopted by the Joint Muni- cipal-County "Zoning Authority. IV. JOINT MUNICIPAL-COUNTY ZONING AUTHORITY THAT a Joint Municipal-County Zoning Authority is hereby established consisting of three Commissioners from the County Board of Commissioners and two members from the Town Council . THAT upon the recommendation of the Extraterritorial Zoning Commission, the Joint Municipal-County Zoning Authority shall adopt the Extraterritorial Zoning Ordinance and to further hear appeals from the decisions of the Extra- territorial Zoning Commission in the manner provided in Section 14-20-6 NMSA 1953. THAT the members of the Joint Municipal-County Zoning Authority si;all hold said position for the period of the term of office to which they were elected on the Board of Commissioners or the Town Council . F TA05, a Mu icipal Corporation By: Mayor A1__T , /C ity/lp erk / AMENDMENT TO THE TOWN OF TAOS ZONING ORDINANCE EXTRA-TERRITORIAL ZONING REGULATIONS TOWN AND COUNTY TAOS, NEW MEXICO WHEREAS, the Town and County recognize that land development and growth is occurring in areas directly around the Town of Taos municipal bound- aries, and WHEREAS, uncontrolled growth will result in land conflicts, traffic congestion, and in general an undesirable environment, and WHEREAS, the Town and County are concerned that growth and development should occur in an orderly manner, and the residents health, safety and welfare are addressed and a healthy environment be created, and WHEREAS, the Town and County desire to maintain the historic, cultural and aesthetic nature of the development Indigenous to Taos and, WHEREAS, as growth occurs demand for municipal services such as water, sewer, police protection, etc. continues to increase, and WHEREAS, Town and County desire to institute effective land use and growth policies that prescribe rules and standards for development by involving, by solicitation and public hearings, citizens views and concerns, and WHEREAS, the Town and County have adopted a policy that while there is freedom to grow, growth and development should occur responsibly and orderly, WE THEREFORE RECOMMEND that an Extra-territorial Zoning regulations be adopted to address the concerns outlined above and attempt to develop policies and pro,:edures for the future development of the areas defined as the Extra-territorial Zone or Zones.
